NIP within 14 days for the registered keeper. Obviously a nominated driver will take longer.

Not true, if the police can prove it was issued and able to be received within 14 days it still counts (say the NIP is issued on the same day as the offence but then the post office go on strike for two weeks it would still be valid). Otherwise all everyone has to do is say 'I didnt get it within 14 days' whether they did or not.

There are other exceptions to the 14 day rule as well.

One of my stupid mates (I have a few) reckons....

the NIP comes requesting name of driver, he bins it

the reminder comes......he bins that


he gets summoned to court on the offence of not supplying the name of the driver

Court "why didnt you comply"......him "I did, with the first request"

Court "why didnt you fill out and return the 2nd form".....him..."cos id sent the 1st and thought they had crossed in the post"

Court "why didnt you return the form by registered post?" .....him..."cos I wasnt asked to"

Him, Royal Mail lose 20 million items a year, they lost the 1st form, I wasnt to know, i didnt send the 2nd because i had posted the 1st"


Some it sounds possible, some of it doesnt......I dont know

It is possible to use the 'lost in post' excuse, it all depends whether the court believes you or not.

They'll either then issue a new NIP which you have no excuse for pleading ignorance about (Ive heard of them being sent registered post and even hand delivered by police officers) or they'll decide your story is unlikely and dish out the fine and points anyway.

I suppose the magistrate could tell you at the hearing that you have to admit you were the driver or provide the other drivers details there and then or within x number of days rather than posting a new NIP. There might be a clause on the NIP that says you have to return it even if you have already completed and sent a previous one, if that's the case I think they would decide it unlikely for both to get lost in the post.

All this delays the inevitable anyway, eventually they'll have to provide driver details and be punished accordingly, and at worst you could be done for perverting the course of justice.
