From the first post it states that the car failed the test on 20th Feb. Her rang the garage the following Friday which would be 27th Feb and his driver got pulled the following Monday on 2nd March.[/quote]


He says...Plate expiry: 21/11/14
Fee paid on: 20/11/14
Car tested: 23/11/14
Car passed: 24/11/14
New plate date 21/11/14 till 21/11/15

That was a different occasion. totally different vehicle. It would seem to be a regular occurrence for him to let his plate expire before getting in renewed.

I think your wrong

The LO/LA can and will remove a plate if they see fit, Tamworth removed plates wholesale on the day all HC's had to be WAV's if they were not changed from saloons

It is also in the regs that plates must be attatched to the exterior of the vehicle for just this reason, not stuck in the back window.

Removal of plate = section 58 applies therefore a formal section 68 notice
MUST have been issued or section 58 would not apply unless licence had
expired or been revoked.

I will never understand why people present their vehicle for testing without at least checking out the basics.

My point entirely X-ray.

Shepway Council's testing station removed my plate once when it failed on a brake imbalance to prevent me using the car. I drove it to my usual garage, tried it on their rolling road, no problems; went back to the council station, no problems, plate re-fitted. Whether it's legal or not, they did it anyway.

If the test is also a MOT (inc or a compliance test) and the car failed, it shouldnt even be on the road......never mind have a hack plate on it

I spoke with the Shepway Licencing Officer the other day and mentioned the removal of plates by the garage. He said they're not allowed to, only he could do that under certain circumstances.

It might have only failed on a minor item like an indicator bulb not being orange enough. I had that as a failure item once. It was orange enough to me but it didn't satisfy the examiner's perception of orange. No doubt the £1 for the bulb went into the tea fund.

I think theres a case from Doncaster - I'm sure MCF will correct me or find the link on TDO in respect of the unlawful removal of plates

Cannock DC will pull a hack off for a blown bulb

The Veichle had been at a local garage for a pre mot, but do not have facility to check headlight beam.
Numberplate bulb was only lit on one side as it has a square plate, and the White taxi plate goes next to the numberplate. (White plates on the back of a car are illegal???)
They have written to me today asking to interview me under PACE with regard to offences under local goverment 1976 act.
