Bolton council are threatening to prosecute and/or remove a P/H operators licence because they sent a Rossendale hackney vehicle on a job booked by a Bolton P/H company. What chance do Bolton Council have? Bolton P/H operators rules state that a journey booked with a Bolton P/H operator has to be collected by a vehicle licensed in Bolton whether it is P/H or hackney.

No chance IMO.

If a convicted rapist can give work to a hackney, then I'm pretty certain a fully licensed PH operator can.

The problem is the law, unless that is changed not much else will.

I'm not sure that such a "rule" would stand up in court.

Is there any case law to back that up?

This is the judgement nearest to what you need. Basically a hackney can legally get work from anyone.

In the past when Berwick upon Tweed Hackneys were in fashion

I believe two operators had there operator's licence rescinded (as not considered fit @ Proper)for using Berwick plated hacks as PHV.

More info Google it

Thanks Bob, but isn't easy to google a rumour.
