The drivers need to check that ALL Council vehicles i.e buses/contract buses/PH contracts have the same policy - if not take them on, they need taking on in any event over a silly policy that does not cover the actual issue.
I think that horse has bolted. The time to challenge the policy was when it was being introduced, not 13 years later.
