Delta taxis win Liverpool court battle to stay operating in city


Delta wins appeal against Liverpool city council which revoked its licence

Sefton-based private hire firm Delta taxis has won an appeal allowing it to continue operating in Liverpool.

Liverpool City Council was also ordered to pay £10,682 in legal costs, after its decision to revoke Delta’s licence was overturned at Liverpool Magistrates’ Court today.

The council had granted Delta a private hire licence for the city in November last year, which included the condition that it had a dedicated telephone booking line for Liverpool, separate from the firm’s Sefton operation.

But the authority became aware that the Liverpool booking number was not operational and the only way bookings could be made was through a phone app.

It revoked the licence in December.

Barrister Joan Smith, representing Delta, told the court the firm had accepted there had been problems with its phone line but had been complying with all conditions of the original licence since April.

Rory Clarke, on behalf of the council, said: “The council stands by its decision made in December last year.”

But he accepted there were no longer any reasons to oppose the appeal.

District Judge Andrew Shaw said he accepted the firm had been operating in accordance with its licence since April, but did not “seek to criticise” the council for bringing the case to court.

A statement from Delta’s solicitor Barry Holland, of Aaron & Partners, said: “After an expensive and drawn out legal battle with Liverpool City Council, Delta has successfully won its appeal.

“Today’s court decision provides a welcome assurance for Liverpool taxi drivers excited at the prospect of switching to higher earnings at Delta. After all, the company has been busy rolling out an extensive network of high priority Liverpool free phones never before witnessed on Merseyside.”

However Karl Barry, an independent liaison and regulatory compliance consultant working with Liverpool Taxi Alliance, said the authority should do more to regulate private hire firms.

He told the Echo: “There should have been a needs analysis carried out by the council on the number of private hire firms in the city before this case was brought.

“The council are tightly regulating black cabs and the same thing should have been done with regards to private hire firms.”

Did the Alliance think it was necessary for the authority to do such regulation when Alpha wanted to expand or for that matter set itself up in the first place or for any other company come to think of it prior to Deltas application?

I guess they've set a precedent for their ph operators by insisting that Delta have a land line number, will they do the same for Uber I wonder

They'll get beat if they try - and delta will lose drivers to uber - end of story

if delta were on the stock exchange - share would be plummeting :lol:

So the council admit they shouldn't have been in court, the judge says he doesn't criticise them, but still makes them pay over £10,000 in costs.
