Hi all, so on the 31st of October I was travelling from clowne to cresswell on the a616 when a black Clio came in the opposite direction scraped along the side of an mgzr in front of me then ploughed staring into the front of my e7,
She blew a positive breath test and got arrested and taken to hospital, now here is the problem my e7 is a 2008 with 240k on the clock so probably market value of £6000 if it gets wrote off I need a taxi that is no older than one year otherwise Mdc won't plate it so where do you guys think I stand on this? I had a perfectly good working taxi before the accident now I may be jobless.

Holy shit Gaz that's some damage there mate.

Have you got GAP insurance on the Taxi?
Have you got replacement car cover while yours is being sorted?
Is there any outstanding finance on the car?

The next one is how to get round Mansfield Councils licensing policy? Ask the Licensing Committee if they'll grant you some leniency while yours is being sorted out.

I doubt GAP insurance will be on a vehicle that is 7 years old. certainly not to the level to be able to buy a car that is 1 year old. I think you will have to go cap in hand to the Council and beg. Mind you, how much compo will you get for your head injury?

Got no finance left on it and no gap cover nor do I have £20k+ for a replacement taxi, shouldn't the third parties insurance take this into consideration when negotiating a payout?

It is Highly unlikely that they will consider anything other than the value of the vehicle.

I would have thought the council would make an exception under the circumstances.

You don't know Mansfield Council, they're a law unto themselves.

Can't you use the money you get back off the cab as a deposit for a year old one? When they write it off you need to be nailing her through the courts for loss of earnings and damages etc etc.

I despise drink drivers with a passion. I'd be on the phone to cab direct now making sure I've got one for the Christmas period.

No you are only entitled to the market value of your vehicle if it was sold on the day of the accident I recently had to write off over £6k on a vehicle. the thing is you should be claiming depreciation from the tax man which reduces your tax bill and putting that into a bank account towards the next vehicle. No insurance company will pay more than the calculated value of your vehicle on the day of the accident.

What you should be able to claim for is loss of earnings whilst you get another vehicle which from the sounds of it would have to be on finance

it depends... one of our mates had a double hit on motorway so his car (old mondeo) was smashed front and back, cost of repair was more than value of so called car (~£3000), insurance company sent replacement car for him two days after... and then it started, insurance company proposed him £3000 which he refused stating that for that amount of money he can't buy any decent car and his smashed car was in good state before, mot'd and serviced so he recomended them to repair his car still using replacement (brand new superb) car. after six!!! weeks of battle insurance company paid him £4500 what he suggested. don't know where's bussines for insurer but cost of rental of replacement car plus that what they paid him was close to value of brand new middle class car...

For a loan Taxi they'll be charging the other insurance company well over £180 a day plus VAT. We had a Mondeo on loan from an accident company and that was well over £200 + VAT a day. We had it for 5 weeks.

Cheers guys, well had a call off the assessor today £10,000 to repair so it's looking like its a total loss, I was supposed to get my replacement loan taxi today but the donut brought down a blue cab instead of a black one that Mdc require so now I have to wait until next Monday before Mdc's testing station can fit another one in, its all fun and games this is

We had a replacement car last year, it was a VW Sharan and it cost £300 per day.
