Minicab driver accused of raping student on London to Cambridge trip



A minicab driver who is accused of raping a student from Cambridge in his vehicle has told a court that all sexual contact with the woman had been consensual and that he had been lured into sex.

Siddiq Mozumder, 33, is alleged to have raped the 20-year-old on the outskirts of the city as he drove her home from a night out in London.

The prosecution says that the married father of four took advantage of the student when she was all but unconscious from the effects of drink.

Mozumder, of Roman Road, London, denies raping the woman, last April.

The jury at Cambridge Crown Court has gone out to consider its verdict.

The court heard that the woman had been drinking on a night out in London.

She felt ill and a cab was arranged to take her home to the Cambridge area.

The court was told that the woman could not remember much of what happened but she did recall Mozumder on top of her with her bra up and the alleged assault was reported the following day.

But Mozumder said the woman, who was fully awake, had climbed into the front of the taxi with him and subsequently performed a sex act on him.

He said he was embarrassed at what had happened and was ashamed for betraying his wife.

David Matthews, prosecuting, said: "Just because she wasn't resisting you took it step by step, further and further."

Mozumder replied: "No".

Mr Matthews asked: "It was her who lured you into sex?"

Mozumder replied: "She started it, yes."

Barry Kogan, for Mozumder, told the jury of 11 women and one man: "There was sexual activity for sure. Such activity there was was entirely consensual, she participated in it and to some extent initiated it."

He said that when the woman was interviewed by police she was not certain that she had been raped.

Mr Kogan said Mozumder had never been in trouble before and was a quiet family man. He added: "He was unable to resist the advances, something he has lived to regret ever since."

The court heard that the woman was estimated to have drunk the equivalent of between two and three times the drink-drive limit during the evening.

The jury will resume its deliberations today.

The hypocrisy of it all is this; If you do anything else under the influence of alcohol whether it be Murder,fighting/assault, theft, urinating in public etc etc you/I are deemed accountable/responsible....if it is supposed Rape/a come on situation.....then you are no longer accountable/responsible! Imo something is just not right in application of the law.

A drunk/intoxicated person is not accountable (for one crime) and wins hands down every time - something just not right in law.


Most people that use alcohol in mitigating circumstances usually have their sentence reduced, at least it is considered not usual behaviour and would not have happened had the person been sober. I feel that as a responsible fit & proper person it is good practice, if not essential practice, to not engage in this manner with drunken people. Apart from the ethical reason of not committing adultery ffs.

I think that you will find that is not always the case; from what I have observed it seems to depend on the severity of the offence/crime.

Do not get me wrong I am not defending the driver or deviating from good practice. With regards to ethics it could have just as easily have been a single guy.

I was basically (if you look back at my original post) pointing out the Law anomaly/double standard that makes one responsible in more ways than one upon committing a criminal act. It would however seem that rape/apparent rape is treated differently! In this case ( and again in many other cases) a memory lapse seems to clear the way for exoneration of all the coming on from the supposed victim that might have taken place, and what never ceases to amaze me is that they can never recollect what happened.......But! the claim is always rape.

I have picked up many a passenger over the years who seemed sober at the time, and then realised during and after a journey has taken place....that they were in actual fact quite hammered. The point being is ; in many cases some hide the state of their condition better than others. Bars and pubs up and down the country are testament to the aforementioned situation i.e sober one minute, and then one more drink.......and right over the edge. The bars/clubs then get the total blame for getting that person in the state that they are in....with no pointing of responsibility to the stupid person who chucked copious amounts of alcohol down their own neck, prior to entering that establishment.

There appears to me to be an imbalance/grey area in apportioning blame. To put it into perspective; Imo it is not acceptable for the victim to claim rape, when to all and sundry she appeared sober....to me it just does not cut it. If she is falling over, Or like Bamby on ice, then that is a totally different situation.

P.S I am not defending the driver or the moral aspect.....but, alcohol does sometimes bring out the real person in the person!

& that is why i would never take a pi££ed up "lone" female , couldn't care even if she lived in wales !! :lol: , always chasing the buck the taxi driver , never understood it, ever! will pick up anything :shock:

Sometimes it is obvious that they are pizzed! Another time they will hold it together.......and then you have to deal with it. You/I will not always get it right...maybe most of the time - but not always.

One of the reasons I stick to days running little old ladies around earns me a living without ever having such problems but in the past when i have worked nights it was quite easy to deal with just don't respond women always take no for an answer in my experience

Minicab driver raped 20-year-old passenger on the way to Cambridge

A minicab driver has been found guilty of raping a 20-year-old passenger in his vehicle on the outskirts of Cambridge.

Siddiq Mozumder, 33, of Roman Road in London, was on trial at Cambridge Crown Court where he denied raping a 20-year-old female victim last April.

On Tuesday, after deliberating for 12 hours and 46 minutes, the jury unanimously found Mozumder guilty.

The jury concluded Mozumder had raped the 20-year-old in an incident that took place on the outskirts of the city as he was driving her home from a night out in London.

The prosecution had told the court that the married father of four took advantage of the student when she was almost unconscious from the effects of drink.

The court heard that the woman had been drinking heavily on a night out in London. After beginning to feel ill, the victim, who cannot be named for legal reasons, called for a cab and arranged to be taken home to the Cambridge area.

The court was told that the woman could not remember much of what happened on the night, but she did recall Mozumder being on top of her with her bra up.

The assault was reported the following day.

Throughout the trial, Mozumder denied the attack and said the woman had been fully awake at the time.

He claimed she had climbed into the front of the minicab with him and had subsequently performed a sex act on him.

He said he was embarrassed at what had happened and was ashamed for betraying his wife.

David Matthews, prosecuting, said: "Just because she wasn't resisting you took it step by step, further and further."

During the trial, the court heard the woman was estimated to have drunk the equivalent of between two and three times the drink-drive limit during the evening.

Barry Kogan, for the defence, told the jury of 11 women and one man that, when the woman was interviewed by police, she was not certain that she had been raped.

Mr Kogan said Mozumder had never been in trouble before and was a quiet family man.

Mozumder will be sentenced at a later date in Norwich Crown Court where Judge Anthony Bate will return on November 16. A date for the sentencing has not yet been set.
