I am sure that this is correct but I just need to clarify.
If a private hire vehicle is standing in a queue of Hackney carriages outside a venue (not a rank) and as the queue of vehicles moves up, the private hire vehicle does the same. Is it touting? Can a private hire vehicle wait in a street next to Hackney vehicles in full view of the public? Is that also touting?

Because he is touting.
Our association received an email from our enforcement team today following a complaint from the trade saying that it is ok for the vehicle to wait around in the queue of Hackneys provided that any passengers he picks up have booked through the office first.

Not sure 'touting' regs are the way to deal with this, although clearly he is.

Plying for hire regs are the easiest way.

But the driver needs to be in the car.

A Private Hire car which, on completing its journey remained in close proximity to a hackney carriage stand was clearly plying for hire when it remained for more than two or three minutes

If there is a proper pre-booked booking then I'm not sure there is a time limit.

Clearly each case will be judged on it's own merits, but anyone with a brain knows when someone is plying when they shouldn't be,

And what are the hackneys doing there ?
As there was a complaint from the trade I'm going to guess a hackney driver has complained about a PH driver touting when they are doing the exact same thing !

It is an unwritten rule if you like, that Hackney carriages are permitted to "rank"in 2 places in the town. These are outside the 2 night clubs. The "official" rank with room for 4 Hackneys is no where near the places where the punters will be so you only get a couple of Hackneys on there at night. The chap in question usually drives a Hackney when he is here working but the Company only have 2 Hackney vehicles on the road and this Private Hire vehicle so the driver is chancing his luck. The Company concerned don't even have anyone taking bookings after midnight.

Jesus! you see that and you don't throw a thunder... if I'm PH and booked I can wait for my customer wherever I like if it's legal to park and I don't obstruct the flowing road traffic even between hundreds of Hackneys queueing for their fare untill it's not an official taxi rank.... or even on the taxi rank if there's not safe place for a pickup nearby coz I don't ply for hire being already booked.... whereabouts you live, mate??? in "Brazil"??? #-o

FFS. The point is that he isn't booked. He is acting just like a Hackney. :roll:
