Taxi Driver Online

Need some advice

Hi folks

I am in the process of applying for my private hire with a council in Scotland.

I am in my early 30's
I have no previous criminal convictions, never arrested, never detained.
I have a clean driving license, last penalty 2010 for mobile, no insurance 2006 and SP30 in 2005, thats it.
I am medically fit, light drinker/no smoking etc.

However, The following monday after applying for my license on the friday I was charged with two offenses;

Voyeurism.
coercing someone into looking at a sexual image.

To summerise, met this girl (32), very steamy, over 20 'sexual images' passed over the course of the relationship from day 1 (she sent the first), and they are all through Facebook private messaging. Great in the beginning as usual, then the relationship broke down, loads of trust issues, very up and down the whole thing had plate lobbed at me. She felt i didnt like her, I did, found out she was going to meet another guy, end.

she works at the local fuel station where I would fuel up at work, coming into contact with all my ex colleagues (150 of us) She'd been with other guys, and over time i'd heard things from her (sexual) that i shouldnt hear about other people. She baited me saying she was going to have 'good banter' with my ex colleagues. I paniced, (just lost my job and felt very insecure) and said keep it shut, how would you like it if I showed people these (previous pictures) another big fight, I said right i'm away for rebound, went out, got rebound, then drunkenly sent her a picture of me with another bird (sexual)

Police pulled me in, I told them my side, they charged me with both offenses, went to court, they dropped voyeurism (she had no right to accuse me of that, you dont smile at the camera when you dont know its there!) but kept the coercing someone to look at a sexual image, with a court date 1st Jan 15

Council put me through medical etc then wrote to me saying i have a meeting with the subcommittee and enclosed a copy of the police report also saying 'i am unfit for license'

I know I have made a real error of judgement here, I am genuinely sorry - I didn't even know what it meant to 'coerce someone into looking at a sexual image'

I'm not a child molester or a rapist or whatnot, but for all the good I may as well have been.

All pictures were taken on my and her smart phones
All sent thought facebook private messenger
All private, never public

I am serious about the taxis, I do take my work seriously, 13 years in tough customer environments, I work well, with feedback surveys and employee of the month etc to prove that. Made redundant through non fault. I have over 40 character references from managers, QC', lawyers, Cabbies, nurses...

I appreciate you will all turn your nose up at this but I would very much benefit from some good advice.

Have you told the council about this yet? If not, tell them NOW!

do Not plead guilty at the hearing on the !st Jan or ACCEPT A CAUTION THAT IS ACCEPTING YOU COMMITTED THE OFFENCE.

iF YOUR FOUND GUILTY YOU WONT GET A LICENSE JUST DISCREDIT THE SLUT AND HAVE EXPERT REPRESENTATION IN COURT

with good representation you should be successful i reckon, do not rep yourself if you get a personal hearing. which should be your first target.

Given your character references A QC and employers i believe you should be given a chance your problem will be convincing the Councillors that your safe to transport the Public.

with good reps you should be successful i reckon DO NOT REP YOURSELF if you get a personal hearing which you must go for and which ideally should be after the court Case is settled, you get convicted forget cabbing in my opinion!

if you get the personal hearing arrange for experienced representation maybe the QC??

They may well know but if you don't also tell them it could be seen as trying to hide things and that will give you more of a problem.

No I wont accept a caution, like you say it is as bad as accepting guilty.

If I am to be found guilty, how long would it be before they would look at my application again?

I will look at a solicitor now, i dont think you get legal aid for taxi stuff though.

Well glad you recognise the Caution trap one the ffylth frequently dump on the unwary!

Dont think about being found guilty one step at a time get a legal rep for the case [if you have ever been in a Union they might be willing to assist seeing your a victim of redundancy?} and get that put to bed, dont see you being found guilty given the sluts history and with a competent brief!

After you win the court case reopen your cab application which if i were you i would put on hold for now,

yeah, I'll phone the cab office tomorrow and find out how easy it is / if possible to suspend a hearing

You most certainly don't want the council hearing before your court case.

You don't want to say anything that would hamper your defense in court, including stuff on here.

The fact that the police have charged you is evidence that they have enough evidence to bring the charge, but not always enough to gain a conviction.

Witnesses often don't turn up, sometimes the police don't turn up.

Let the court process take it's course and worry about being a cabby afterwards.

Phoned them, tried to stop it, said they couldnt and I still needed to come.

I'm surprised the court will allow it, in the same way the coroner always waits until after the outcome of any court case dealing with the death of a person.

Also I wouldn't want a witness to give evidence to a council and different evidence to a court.

You need to seek professional legal advice.
