They are using it to prosecute.

They generally need two pieces of evidence, one will be the (at a guess) an eye witness statement, and the other will be the CCTV evidence.

Is your area one that has de-criminalised parking and street enforcement? If not then maybe the police can use that CCTV.

Yes we are de-criminalised. theyn are just using the CCTV evidence.

can the police use ordinary street CCTV cameras to enforce against motorists? Does this require any traffic order or anything?

Like Chris the Fish says RIPA but, if you do a FOI request they'll come back with overt surveillance.

The rules on the use of RIPA changed a couple of years back. Authorities/Police are only permitted to use RIPA for covert surveillance of offences that attract a minimum custodial sentence (if memory serves me correctly) of 6 months.

Public space cameras that have the required signs ( E.G. - CCTV is in use in this area) displayed do not require more than that to carry out observation of public areas.

When they were looking at us through the CCTV cameras a few years ago due to us over ranking we questioned them and asked which law they were using? Their reply was, "we are using overt surveillance."

Is that enough to prosecute?

Let me make one thing clear here, I am all in favour of the police prosecuting people for driving through our pedestrian zone and using a road that is clearly marked busses only. But there is no point in them doing it if some smart lawyer is going to be able to get the cases thrown out.

I think you are right.

But if the charge is dangerous driving then the max penalty is quite high.
