This is quite a hot topic at the moment one way of cutting down is the intended use policy which Rossendale and others are adopting at the moment. I have another suggestion which if legal could stop the problem overnight which is instead of trying to control the drivers why don't the the licensing authorities impose the condition on every one that holds an operators licence in there area that they can only rent radios/data heads to drivers who hold badges in the same area.
I would expect the howls of protest from some operators to be ear splitting but to me it would seem to be a perfectly reasonable condition and most importantly clearly in the publics interest.

A hackney carriage can work out of a private hire base in another borough other than the borough it is licensed in. Currently there is nothing in Walsall Council’s Licensing Conditions that says a Hackney Carriage licensed in Walsall must do the majority of its work in Walsall.

As Hackney Carriage ** is working in Lichfield, any offences are taking place in Lichfield over which Walsall Licensing Enforcement doesn’t have any jurisdiction. We are not allowed to ask a base in Lichfield for their records. This comes under the jurisdiction of Lichfield Council’s Licensing Enforcement department.

You will have to lodge a complaint with Lichfield Council and it is up to them to decide what action to take.

If they do decide to take action and are successful, they can then notify Walsall Council’s Licensing Enforcement department and we would then be able to look at taking the owner of Hackney Carriage ** before Committee who can decide if the said owner is a fit and proper person to hold a hackney carriage licence.

Sounds like - by working out of the LA on a regular basis - the owner might not be "fit & proper"....maybe on the grounds that they took out a plate/badge with no intention of working there?/

Can a condition be laid upon a base if that base is wholly hackney? if it held a PH ops licence it could, in theory

A Hackney base does not need to be licenced..

A Hackney base does not need to be licenced..

I doubt that would be legal as it would constitute a restriction of trade surely ?

Not many bases are 100% hack or 100% PH, hence "mixed" and hence a PH ops licence will ne held somewhere

we have 100% bases that are hackney......they need no licence....
