Swad Cars private hire vehicle driver fined for having no licence



A PRIVATE hire vehicle driver has been fined £300 after being caught behind the wheel without a current licence.

Khawar Sadaf Khan, working for Swad Cars, based on the Sharpe's Industrial Estate off Alexandra Road, Swadlincote, was stopped in Ashby on June 5 last year as part of an enforcement operation being conducted by North West Leicestershire District Council.

The 30-year-old was asked to produce his licence but was unable to do so, meaning the case was reported to South Derbyshire District Council as the licensing authority.

It was established that Khan was not registered as a private hire driver in South Derbyshire – his previous licence had expired more than a year earlier and he had not renewed it.

Khan, of Sunnyhill Avenue, Derby, pleaded guilty by post to driving the vehicle without having a current private hire licence and, in his absence, Southern Derbyshire Magistrates' Court fined him £300, as well as ordering him to pay £250 in costs and a £30 victim surcharge.

Councillor Michael Stanton, chairman of the council's licensing and appeals sub-committee, said: "It is paramount that we try to uphold the safety of everyone living in, working in and visiting South Derbyshire and part of that commitment involves us ensuring private hire vehicles are properly licensed.

"Operators have a duty of care to their customers and must meet high standards in terms of licensing and their vehicles.

"If anyone needs to call on the expertise and advice of the council's licensing officers then we'd advise them to contact us. We will be more than happy to help."

Surely the operator of Swad Cars should have been prosecuted for using an unlicensed driver and operating a vehicle with no insurance?

Maybe he will be. It is probable that any such prosecution could be reliant on the outcome of this case first.
