Where do car renters (just add fuel, pay rent at end of week) meet these criteria?

You’re probably self-employed if you:

run your business for yourself and take responsibility for its success or failure..........no, turn up and drive.
have several customers at the same time.............................................................passengers yes, base no
can decide how, where and when you do your work...............................................vaguely
can hire other people at your own expense to help you or to do the work for you.......no
provide the main items of equipment to do your work.............................................no
are responsible for finishing any unsatisfactory work in your own time......................no
charge an agreed fixed price for your work............................................................meter or quoted might be yes
sell goods or services to make a profit (including through websites or apps)...............via the base

i make that 4 out 7 in the NO ist

If the car is rented then it could be said that you are providing the car. What would be the difference between renting a car from a base or renting a car from another place or buying on a loan or HP or even leasing the car?

If the car is rented then it could be said that you are providing the car. What would be the difference between renting a car from a base or renting a car from another place or buying on a loan or HP or even leasing the car?


Because, maybe, if i buy a car on HP i am investing in my "business"? and i have many customers, i can decide where/when i work and i take responsibility for success or failure.....renters should at least pay BEFORE taking a car out like i would off Thrifty or Enterprise car hire

I know FOR A FACT that "jockeys" (drivers in an owners car) in a local town all had to go PAYE after HMRC came calling (seems an owner driver got cheesed off with all the new drivers and rang them) who had for years thought claiming they were "self employed" would suffice.....they were on a split bag

clearly - in some cases - it doesnt

Split bag is different there the driver is receiving a wage (percentage of takings). if you rent a car you are in effect taking on the risk of not getting any custom and failing to take enough money or earning a ton of money and paying the same in rent but going home with a big wedge in your pocket your car rent is in effect a cost to your business which is driving a hackney/PH.

also with split bag the total takings of the vehicle count towards VAT :wink:

OK, so thats a split bag...

what about where a renter pays (say) £300 a week and gets no receipt for the rent?

maybe the base is OK, if it all gets recorded/banked/declared as takings/income inc vat, what about the renter?

they either under-declare takings by £300 a week (having paid rent) which HMRC might not like or declare all takings-less all costs which would leave THEM liable to £60/week tax on the rent theyve handed over....which THEY might not like....

That is simple. If they won't give a receipt don't work for them.

6 years back tax at £3120 a year = 5hitabrick time

plus tax on personal useage where the renter has the car 24/7

Surely renting a car is the same as renting a premises when it comes to whether somebody is self employed

only if the premises come with stock....and insurance/leccy/phone...
