I think that is a non starter. the machines used at the station are very accurate and calibrated. How many cases have you heard of where someone has successfully argued that the breath test at the station was wrong? I am fairly certain that you don't actually have to be over the limit for a council to revoke on the grounds that any amount of alcohol can affect your driving.

cant see a driver winning tbh - but if he does then good - so if he's caught again in the process kills someone, then the council can say they only issued the license because the court told them to.

I hope not any unnecessary death is one too many if the bloke is a liability and he failed 2 breath tests then we don't want people like him in our trade

AS A TRADE UNION REP I DEFO WOULD NOT REPRESENT ANY DRIVER FOUND TO BE OVER THE DD LIMIT.............HES A FOOL AND HAS NO PLACE IN THE INDUSTRY :evil:

I think he has no chance of success.

The police advised the council of their findings, and the council acted on them.

The driver would have to prove the council acted unreasonably.

And I don't think he will.
