I got a parking ticket for being stuck in a queue of traffic, claims uber driver

Driver says the enforcement officer who took pictures of his car was stuck in the same queue in Spinningfields

A uber driver says he was slapped with a parking fine for waiting in traffic in Spinningfields.

The Uber driver claims he was driving down Hardman Street onto Byrom Street when he was snapped by the traffic enforcement officer.

Adeel Muslam, 31, was sent the Penalty Charge Notice along with a single photograph of his number plate, by private company, ES Parking Enforcement Ltd but was sure he had not parked in Spinningfields.

He asked for more pictures and when they arrived - four months later - he says he was shocked to see they had been taken whilst his car was queuing in traffic.

Speaking to Manchester Evening News, the dad-of-one vowed to go to court to fight the unfair fine, he said: “I couldn’t believe it when I got the fine in the post.

"It is outrageous and astonishing to be honest. They only sent me a photograph of my number plate so it could have been anywhere.

“I asked them for more evidence and they sent me these other ones. Showing me sat in traffic. And the person who took them was in their car as well. It’s bang out of order.

“It’s obvious I was in the car, driving and sat in traffic.”

He was initially fined £35 in May - but that has since risen to £200 as Adeel, from Bolton, during more than three months to be sent the other photographs.

Adeel, who has been a taxi driver for four years said: “Not only did I get the fine but a load of threatening letters from solicitors if I didn’t pay up. But I won’t pay. I will go to court if I have to. I was driving my car. It’s disgusting. How many other people have fallen victim to this type of underhand behaviour. I have to say something and try and show this is not acceptable.”

ES Parking Enforcement declined to comment on stating this was due to ‘data protection’ and refused to explain why it had taken four months for them to send additional photos to Adeel.

Uber have also declined to comment.

Earlier this year a delivery driver won an appeal for a parking fine from the same company.

Philip Baxter was parked up in a loading bay in Spinningfields in May, and was snapped by enforcement officers in an unmarked car.

The 31-year-old from Stalybridge said the officer was ‘undercover’ - and that violated the Independent Parking Committee code of practice by using 'predatory tactics'.

The Independent Appeals Service overturned the fine £100.

I received one today from, Edinburgh council, for using a bus lane at 1.30AM.
Now considering the usage restrictions stop at around 6.30PM, and the fact that its a licenced taxi, that can use bus lanes, why are they sending out fines,
I just wonder how many innocent folks have received them and paid??.
I just filled in my details and sent it back without a stamp, telling them to look at the second photo that was enclosed, and to stop being stupid.

Unless your vehicle is on their database you will automatically get the ticket. All you need to do is send a copy of your vehicle license and it will get cancelled and your details will be entered on the database so that it doesn't happen again.

Also make a proper appeal through the proper channels. You could be faced with a visit from bailiffs in a few months time.
