There's been a concerted effort by the Cambridge minibus and taxi operators that has forced Cambridge council into an inquiry over such activities. VOSA/DVSA have been involved and there was a high profile case recently of on operator in York who has been told that their drivers must have DCPC, PSV entitlement and their minibuses must have COIF and be licenced as psv's. Their application for a PSV operator licence was refused.

Thanks to the European Commission for listening to Ian Ashman and Martin Allen of MJ Cars bringing this sort of thing to their attention. the UK government now has to take action as infraction proceedings have been taken against them. all this despite brexit, as the UK is still an EC member and has to abide by their rules, before anyone starts that line of reply!

Should the Council Officers and Elected Members of Councils who are allowing this blatant violation of Regulations that are in place for PUBLIC PROTECTION and protection of those Businesses who abide by them be investigated and prosecuted ?

I believe they should be prosecuted for failing to carry out their duties whilst holding public office and consequently made to resign from the positions they hold without recompense.

They're pissing a lot of companies off round here. Why should companies have to do everything by the book when they run about on Volunteer status breaking every law in the book?

The law regarding the use of voluntary sector vehicles is clearly covered. None of the "authorities" have chosen to follow those laws over the years because they think they're getting the job done cheaper by voluntary services. there's been enough test cases both here and in the European Court to provide very precise rules as to what is and isn't acceptable. I won't repeat them here as most have already been posted in the court cases and legal sections on here.

Basically, if money changes hands for a journey except for family and friend, then it is hire and reward (a term not recognised by the European Courts, they use the term "for fiscal activity). Any form of reward, be it a free meal, petrol money, whatever, slam dunk. The vehicle, driver and operator must be properly licenced. Simple.
