I don't have a problem in changing the status of drivers. We already have some who are employees. If the others have to go the same way it is fine but they wont like it.

I am not so sure anybody has thought about the practicalities of this

Firstly how would a PH or hackney based company employ someone who supplies ,maintains and insures their vehicle. Does this mean that they will have to stop having owner drivers on their books ?

Secondly if a hackney driver is paying a "settle/board rent" and is receiving work from a company but otherwise able to take work from flagdowns, a rank or off their own phone via an app how is that not self employment ?

Thirdly as many hackney drivers do NOT keep proper records of their takings how can a company know what they have taken to work out tax and NI which the driver has already pocketed as it is their takings

Fourthly if this means many taxis/PH are going to suddenly have to start paying VAT on takings and all the extra costs in NI surcharge and pensions is the market going to stand a sudden price shock ?

Fifthly many councils including ours operate a policy of deliberately licensing enough taxis to ensure there is never a shortage of supply what are the implications for this ?

Same way a plumbing firm employs a plumber who has his own tools and van.

Just because someone is employed it doesn't mean they can't claim back tax, and/or have their own tax return.

I'm not sure the above differs that much form the freedom Uber allow their drivers to do, i.e. they can take work from anywhere else.

This is the bit that concerned me when the GMB took on Uber, but clearly it didn't concern the tribunal.

If they want proper working conditions and safeguards then best they learn to keep proper records, it is the law that they do.
