My company is completely the other way round;

We have to have cars a certain colour,
We have to wear company branded clothing (which we have to pay for),
We have to work certain shifts : Day cars at school times, night cars between 2am-6am on a rota to ensure enough cars out overnight (or pay £20 to get another car to cover),
We have to charge less than the council metered rate on all jobs (except HC on street work),
We have to do contract work at a discount,
We have to give a discount if the customer asks (10%),
We cannot refuse to do a job once it has been accepted on the datahead (without a valid reason, abusive, non payer etc.),
We have to pay rent even if we are on holiday, off sick etc.,
If you're a hack you are not allowed to do street work when the phones are busy and there's booked jobs waiting,
We have to do distance work on fixed prices set by the company.

If you don't comply with any of the above you are called to the office for a disciplinary, at a time decided by the owners not of your choosing. At which you are told you must do/not do this and that, it's the company rules. When you remind them you are self employed and should be able to choose how you work, within legal requirements, the answer is always ' if you don't like it go and work for someone else, we don't have to accept your rent '.

So it looks like the company wants to treat us as employees, telling us what we must do, but leave all the expense of being able to work, and pay for the running of the company to us.

Sasha clearly the you are a worker under the direction of the company and are entitled to employment rights, the disclipinary procedure you outline is clearly illegal and renders YOUR company to be acting illegally rendering then not FIT AND PROPER.....................join the GMB and whack the fookin scum =D> =D>

It is businesses like this that the tribunal decision is aimed at.

Grandad the legislation dealing with Company's like Sasha's has been in place for decades the Uber decision has just given it publicity :D

I suspect the majority of PH companys act in the despicable way Sasha's do and certainly Hermes the courier company can be even worse!

A decent Union rep should be able to shut sasha's cowboys down within about a Month i reckon OR force them to act within the regulations BUT of course that would require the Drivers active participation in negotiations i would thoroughly enjoy fookin this shower up =D> =D>

If sasha wants emm grassed up to the revenue he only has too PM me their details and its job done

So the way my company works isn't the norm then ?

Every other company in my town works the same way, all either owned by 'businessmen' or shareholders. None of the companies have their own cars they rent out, everyone on the fleets are owner/drivers that pay rent to drive on a company and all have the same rules or very similar. I presumed it was the same throughout the country.

Very interesting as I've repeatedly told the owners they can't issue fines for breaching their rules and threaten to stop me working until I do pay, force me to work certain times (again fined if you dont) or force me to give any discount. Yet the reply is always 'company rules, if you don't like them - drive for someone else' :x

Do you work as part of a coop, or do you rent a cab from someone on a coop circuit n
I own my own car which I rent out to another driver, and pay a weekly rent to a company which is (supposedly) run by shareholders who elect directors from the pool of shareholders. However it's the directors who make all the rules and use their 'proxy' votes so any decisions go in their favour.

In a local town with 2 circuits/bases an owner driver got pished off seeing badge holders turn on his shift, jump in a car on a split bag and take work when the car was also out on the rest of the day with its owner so he rang HMRC.

All jockeys (non-owners) are now PAYE, not "self employed"
