has school runs, now 1 kid has just started going crazy in the car , kicking it & trying to put the windows out & he picked up his sunglasses & mobile the other day & threw them out the window, now my mate is a placid lad & just stopped the car & retrieved the said items,( i would have just battered the little tvvat tbf & lost my badge) phone was ok, anyway the kid has started spitting at him & the escort, he has refused to pick him up now ( who would tbh ) but the council phoned him & told him he HAS to pick him up or lose the run for that kid, so he stuck by his guns & refused, he is now £90 a week down, although both the parents dont work & have a merc 4x4 on the drive ( lovely car by all accounts) , why dont councils back the driver ? if i was at the council i would just say , sorry he is out of control, here is a £10 fuel voucher, take him yourself , why are we scum in this trade

Like it or not, the council have a legal obligation to provide transport for the kid. However your mate can give notice that he doesn't want to continue with the contract. There may be some kind of financial penalty imposed depending on the wording of the contract because by refusing to carry out the contract he is in breach of that contract.

We had 1 who had got through 12 taxi drivers, we had him for a year, added an escort and had him alone out at night across the town then back for the other lad on a 30 mile trip, just to seperate them, this one had knives, set fire to paper in the car, then 1 night i picked him up, he got in the front and by the time we got to the 12ft fence and electric gates (yeah) he grabbed my phone, i had him in a headlock till he dropped the phone, he opened the door and ran off

i turned back to the school office, told them i didnt want him in the car and he never was again.

county paid dad to take him in/out............for 3 weeks then he got banned totally

County have changed attitudes so much in 2 years im looking at jacking it all in

They have a list of "fines" and admin charges should something go wrong

When i started in 2008 they said to ring the office if i couldnt cover a job, last month i got told i MUST arrange cover, they are shifting responsibilty 100% onto taxi owners

And getting a decent rate is getting harder each time, I have won twice but cant see how some cars make any money, Burton cars come empty to Tamworth, drive 30 miles loaded the 15 miles back to Burton, so a round trip of 60+ miles, Tamworth cars cant be cheap enough but 1 Burton firm must bid stupid low just to get work

Maybe I wasn't clear. Yes your mate can refuse to continue at any time and for any reason but the Council may impose a penalty for breach of contract should they choose to do so.

Nobody has to take anyone who acts in an unreasonable manner..

If the kid is behaving in an unreasonable manner, and putting the driver and/or vehicle in danger, then no civil court will make the driver pay any loss the council accrue.

A breach of contract works both ways! As Sussex alludes; if the OP kicks off, therefore a breach of contract has been committed against the driver.

Drivers and Companies take more crap than they should - If they misbehave, then you kick them out/stop the contract, just as you would with any other person.

one of my mates had a job with girl with adhd, she couldn`t sit in one place for a minute and she was loud and few times she spat at him and an escort lady. as it appeard after few times he was nineth or tenth driver who was assigned for that job even not knowing about troubles girl is making (coz he`s foreign and maybe he can cope). after few days and when he was done with that he stopped his car in the middle of nowhere and told her to f00k off and leave now (escort sat quietly)... girl begged him to not leave her crying but he wasn`t showing any of empathy to her (that`s an escort lady statement). after few mins of crisis she wore her suspenders and stayed calm to the end... never happened again. £160 a day job... 30 miles one way twice a day...

When tendering for school contracts here there is usually information regarding "challenging behaviour". I avoid those like the plague because you know what is going to happen. On occation, we have been caught out and terminated a contract or refused to carry certain students. So far I have always managed to justify such action and avoided paying the Council charges, but that doesn't stop them trying to claim from an operator.

That maybe the case but that doesn't mean a Council wont send you an invoice and you then have to defend your actions.
