Id be interested to know how one goes about appealing such things

Once it's attached to your license you appeal to the mags court.

Otherwise it's Judicial Review at the High Court.

However, unless the council have acted procedurally unlawful, or have acted in an unreasonable manner, you will lose.

You apply to the magistrates court.

or join a union or taxi association and get them to take the council to court

we don't have an association here it folded due to lack of support

some of us considered re starting it but decided against as there is little team work here

I am not in a union but several I believe are
sadly in my mind the trade here doesn't understand how a union works nor do i believe they would support it when required

Have a read of Stockport M.B.C. -v- Eyles you might find it interesting

good case and is the one from Durham, but aren't they hackney carriage cases, with one from Stockport made reference to losses in advertising revenue on the HC's.

My main issue with this, in respect of PH, is that the council don't know what they're creating - an entire fleet of vehicles that aren't taxis, but to the wider public are believed to be taxis.

Indeed, the concept of private hire isn't uniformity, they all vary in their charges and vehicle types.

Very good, the public will also think they are owned by one company, and if there's an incident will not be able to identify the vehicle, other companies will take other companies bookings causing all out war. He does not say what advertising is allowed but if you have a livery you effectively ban advertising which has always been a source of income for taxi drivers.

with ranks a mix of company cars and owner drivers it makes no difference, drivers have badges and dashboard ID's

taxis have always nicked jobs

and many LA's dont allow adverts on cars anyway

Under legislation hackneys may carry advertising, it's only private hire over which councils have the power to allow or prohibit.

interesting responses guys, thanks

on the note of advertising our council charges to approve any advertising
though the majority of companies here only have their own details splattered all
over the car.

Wasn't aware legislation covered this on Hackneys though

mind you legislation counts for little with Canterbury City council

I'll do other threads on that Concerning

meter use

taxi private hire accounts

increase to our fees of 3% annually

and thats just whats on top my head right now
