That states "in an individual case." not "in the case of an individual."

Individual case meaning.

Well, precisely a single person or THING.

So the Deregulation Act clearly referring to an individual case of licensing, not trying to distinguish an individual licensee from a business entity.

The explanatory note you quote says:

And if you look at the wording of the actual legislation, it says:

Deregulation Act, section 10(3)(2) wrote:
Every licence granted under this section shall remain in force for five years or for such lesser period, specified in the licence, as the district council think appropriate in the circumstances of the case.

So the actual legislation simply refers to the "circumstances of the case", thus nothing to do with individuals v companies, or whatever.

Either I'm going mad, or we had a similar discussion a year or so ago.

That said I take the view the 'individual' can be a person or a thing.

Just hope that was I said in my imagined (or not) post previously. :D
