A judge told Ali Dayani it was 'a stupid thing to have done'

A taxi driver tried to dodge having points added to his driving licence by giving the name of a dead man to police.

Ali Dayani filled out the man's details twice on "notices of intent of prosecution" issued by police over a speeding offence and activating a red light camera.

Nottingham Crown Court heard the offences were in April and May last year when the man had died on September 7, 2016.

It is unclear how the accused knew the individual, but he had managed to get his date of birth, full name and address in Bradford.

When the dead man's man family were contacted about the offences, they informed police the person named as the driver had passed away months earlier.

This led to the arrest of Dayani, 29, of Glamis Road, Basford, and a court prosecution for perverting the course of justice.

Judge Steven Coupland, who dealt with him, remanded him in custody earlier this week.

Appearing back before him on Friday (March 1), he asked him in the dock what custody had been like and Dayani replied: "I didn't like it".

The judge told him: "You will appreciate that perverting the course of justice is a serious offence and nearly always results in a custodial sentence, because it strikes at the heart of the criminal justice system.

"You are in a serious position because you avoided having points on your licence by what you did, and you did it twice".

A Toyota Yaris was being driven as a taxi on May 15 when the car was caught on a red traffic light camera on April 15 in Radford Boulevard.

Then a speed camera was activated by a white Mercedes doing 47mph in a 30mph zone in Alfreton Road on May 11. Dayani was the registered keeper.

After the offences came to light, the brother of the deceased man said it had caused him distress, said Lisa Hardy, prosecuting.

Both traffic offences were not taken any further because the statutory time to prosecute had expired.

Rebecca Da Silva, mitigating, said Dayani had worked in the taxi industry for two years and is the sole-provider for the family.

"This is an offence which occurred through panic and, if I can put it this way, clouded judgement," she explained.

"It wasn't a calculated attempt to pervert the course of justice".

She stressed he had the matter hanging over him for ten months and he had pleaded guilty at the earliest opportunity.

"He is remorseful and ashamed for his actions. He is of good character. References speak of him as kind, generous, a reliable young man, a good, honest person and a dedicated father to his two-year-old son".

The judge told Dayani: "I have read a letter from your partner telling me about your circumstances and your two-year-old child and the great effects on them if you go to prison. You have been out of trouble for ten months since this, and I agree this shows it was out of character for you and a stupid thing to have done".

The judge gave him two months consecutively on each charge, suspended for 12 months, saying "whether you do more time in custody is entirely a matter for you".

He said six penalty points will stay on his licence, and "I can't impose penalty points for what you did, so I will disqualify you (from driving) for one month".

"Go downstairs to be released to be with your family. Don't let them down".

Because many do.

However I think the judge got it spot on.

One week in custody waiting for reports, and then suspended sentence.
