can ANYONE tell me where to find a full copy of the licencing laws for P/H in ayrshire.
been having heated words with a few of the other companys about a few things...
i asked the council...they said i would have to apply in writing WFT !!!.

can anyone help here ..PLEASE ?
or does the scottish P/H law apply to the whole of scotland...or do certain councils have differant rules from another

Ask them for the information but head the request FREEDOM OF INFORMATION", this has worked for me a few times.

They all have different vehicle and driver conditions. But you are fully entitled to know what they are.

Just send them an e-mail and ask.

If there are any regulations set by the council they must have a copy in the local library. There is nothing wrong with asking them direct for a copy, it might cost a couple of quid.

Each local authority will have their own set of terms & conditions which they will have to give you under the Freedom of Information Act

They say you will have to apply in writing, which by law is correct, but what they never told you is that you can ask for it by email

All councils have to work under the Civic Government Act, which provides the broad framework, but each council also sets its own licensing conditions - you should be able to get a copy of the condtions from the council.

What are the issues that youre having a problem with - the conditions don't seem to vary greatly between councils, so perhaps the people on here could help you out a bit??

What about the council insisting that all private hire cars return to base when a hire is complete.
We are about to get letters telling us we must return to base.
West lothian is a rural area and we get calls from all over, if we are required to return to base
1) the cost to get a hire goes up
2) waiting times increase
3) there is less chance of the hire being there

Question 1
Is the base the address the car is licensed to (the owners address)

Question 2
Is the base the address of the control room

Question 3
Is the base address the drivers home adress
This will put a lot of the guys out of the game.

1 car operating from my OWN house...which is private .

i was also told by these other t***s...sorry..the compition , that .....

you CANNOT run a taxi business from your own home...you have to get office premises...

you CANNOT run taxi business from a council house at all.

but...the licence lady said......i could run 1 CAR from a PRIVATE HOUSE, in term..not a council house , as long as i kept it to 1 car only.

anyone else shed anymore light here ?

As you don't have any legislation concerning base stations at the moment, I'm quite intrigued as to how they can demand you do anything in relation to them.

Maybe ask under what section of your act they are working under.

It could well be planning law that forbids you from running the firm from your house, not licensing law.

But it appears there is nothing stopping you running one car from your house.

So if you build up your firm, just get any new drivers to run their own cars from their own houses.

we have approx 3 owner/operators down here in my town with 1 car each running from there private houses.
so i canny see how there can be any probs....

as you dont yet have laws for radio firms.
then why cant you give your car as your business address?

As I said last week when you asked it's a planning issue, and has nothing to do with licensing.

I know people who have had problems with neighbours and the like because they haven't applied for planning permission.

What youve been told are probably just the guidlines, and each case is probably considered on its merits.

The council can just license vehicles and drivers and have no licensing powers as regards any base that you use.

The base doesn't really exist in law, so it would be interesting to know how they specify the address, but it must be the office unless you are working from home.

The lesislation does specify that you although you can go to another licensing area to do booked work you can't hang around there, but apart from that theres seems little basis for your council's action.

Did they consult you on this? Maybe you could ask them what legal basis they have for this.
