Angry motorist smashed up taxi with tyre wrench at Falkirk train station

A parking row got out of hand when a motorist retrieved a tyre wrench from his car and proceeded to strike the wing mirror of a taxi.

Robert Cupples (48) appeared at Falkirk Sheriff Court last Thursday having pleaded guilty to possession of a weapon – a tyre wrench – and recklessly damaging property at Falkirk High Railway Station on May 22 last year.

Danielle McDonald, procurator fiscal depute, said: “The accused and the taxi driver had an argument about the accused being parked within the taxi rank – then the accused took out a tyre wrench from his car.

"The witness then got into his vehicle to leave and the accused began to chase it, swinging the tyre wrench at the rear of the vehicle, which was going around a mini-roundabout and stopped. The accused hit the wing mirror of the vehicle with the tyre wrench and damaged it.

"Witnesses came out from the train station to see what was going on. They saw the accused brandishing the tyre wrench and the police were contacted. Officers arrived at the station and traced the accused who told them ‘no I didnae’.”

The court heard the taxi driver had allegedly spat in Cupples’ face and this is what prompted him to go and get the tyre wrench and actin the manner he did.

"He made that complaint at the time,” confirmed defence solicitor Simon Hutchison.

Sheriff Craig Harris said: “His reaction at being spat at in the face cannot excuse the criminality that followed, but it’s certainly mitigative.”

Mr Hutchison said whatever the case, his client should not have done what he did.

"His overreaction to whatever happened before was still an overreaction – he should never have taken the tyre iron out. The taxi driver did start it when he argued about Mr Cupples parking in the taxi rank.

"He acted out of character and is very sorry for his actions.”

Sheriff Harris asked for the cost of the damage to the wing mirror and was told it was £1,500 – which Mr Hutchison found difficult to believe.

"I can’t accept that cost,” he said. “There’s no way a wing mirror would cost that.”

Sheriff Harris deferred sentence on Cupples, 45 Woodburn Road, Falkirk, to May 26 to ascertain the true cost of damage.

Does that mean the sheriff accepted that the taxi driver had spat in the accused's face? :?

I had an altercation with a coach driver many years ago which ended with him punching my cab. He jumped back on his coach and drove off, I followed him while on the phone to the police. Once he’d :D stopped the police turned up and inspected the damage to my cab, a dent in the rear quarter panel. He then claimed that I’d spat at him (I can’t think of a anything worse, I’d rather be thumped!) when it was put to me I told the police to arrest us both and do a proper investigation, including taking my DNA and testing his top for my saliva. Once the driver heard me say this he changed his mind, saying he didn’t have time for all this and offered to pay for the damage. The copper winked at me and marched the guy to a cash point and returned with £150 for me! Most of the Dent pushed out and I never bothered having it repaired.

I hope not.

Maybe matters will be clarified at the sentencing hearing.

Of course, it could be total nonsense, and just made up to justify the attack with the wheel wrench :?


Furious Falkirk motorist kicked taxi after driver allegedly spat on him

Cupples appeared at Falkirk Sheriff Court on Thursday having pleaded guilty to possession of a weapon – a tyre wrench – and recklessly damaging property at Falkirk High Railway Station on May 22 last year.

The court heard the case had been continued three times in order to get some proof of the cost of the damage to the taxi – which at one point had been claimed to be as high as £1500.

Sean Iles, procurator fiscal depute, said Cupples and the taxi driver had an argument about the him being parked within the taxi rank – then Cupples took out a tyre wrench from his car.

The taxi driver then got into his vehicle to leave and the accused began to chase it, swinging the tyre wrench at the rear of the vehicle, which was going around a mini-roundabout and stopped.

Cupples then kicked out and hit the wing mirror of the vehicle, damaging it.

The court heard the taxi driver had allegedly spat in Cupples’ face and this is what prompted him to go and get the tyre wrench and act in the manner he did.

Defence solicitor Simon Hutchison said Cupples was at the train station dropping his daughter off.

He added: “This taxi driver had blocked him in. He came over to Mr Cupples, who rolled down the window, and the taxi driver spat in is face. He told police he had been spat on at the time and is still waiting to find out what’s happening with that.”

Sheriff Derek Livingston said: “Whether you were provoked or not, you shouldn’t have had a tyre wrench out anyway – even if you were spat on, you shouldn’t have kicked the wing mirror.”

He fined Cupples, 45 Woodburn Road, Falkirk, £420 to be paid at a rate of £15 per week.

maybe he thinks if he repeats the lie enough people will start believing him
