The taxi incident is straightforward enough, but all the sentencing stuff etc requires careful reading :?


Ellesmere Port teenager racially abused taxi driver in Chester

A TEENAGER who racially abused a taxi driver in Chester and kicked out at his vehicle has been ordered to pay hundreds of pounds in compensation.

Evan Wright, 19, of Rossmore Gardens, Ellesmere Port, pleaded guilty to charges of racial abuse and criminal damage when he appeared at Chester Magistrates Court on Tuesday, September 13.

Prosecuting, Emily Comer said it was at 4.50am on February 5 when the taxi driver, Tahir Majeed, was working in Chester.

Wright was part of a group of seven who all tried to get into the taxi, which had a passenger capacity of five.

Mr Majeed explained to the group that not all of them could get in the taxi.

One of the group, 20-year-old Jacob Sutton, punched the driver-side window of the taxi and kicked the side of the vehicle, and Wright joined in by kicking at the side of the taxi.

Mr Majeed was said to be scared and phoned the police.

As he got out of the car to assess the damage, which included a bent wing mirror and muddy marks down the side of the vehicle, Wright returned and hurled racial abuse at Mr Majeed.

He called Mr Majeed "dirty", a "paedophile" and a "P***".

Police arrived and arrested Wright, who apologised for his language in police interview.

Wright was of previous good character at the time of this offence, but had since been sentenced at Chester Crown Court for affray and received a suspended sentence.

Defending, Chris Hunt said Wright had made admissions in police interview and had shown his phone to officers which demonstrated what he had done.

Wright had been going through "a tough time" when the offences happened, but had made changes in his life and was now in work.

When charged with the other offences, he had initially been denied bail, so had spent a weekend in custody, which had been a "rude awakening" for him, before bail was subsequently granted.

His parents did not condone his behaviour but were supportive of him, and he had acted "out of character". He was also aware that committing any further offences now would lead to a prison term.

Magistrates heard that co-accused Sutton had, at a previous court hearing before Chester magistrates, been ordered to pay £756 compensation for the criminal damage.

Wright was told to pay £850 compensation, as he was also guilty of racial abuse.

He must also complete 100 hours unpaid work. No court costs or victim surcharge were made due to compensation taking priority.

So presumably the suspended sentence he received previously is irrelevant because the offence here took place before the suspended sentence was imposed? :-s
