There's an old thread on this, obviously, and not much new in here apart from the obvious. But worth reading for anyone unfamiliar with the case.

It's not clear if the driver actually died yesterday, but that would be precisely one year after the attack on 6 April 2022.

The detail is in the older thread here:

Dundee taxi driver dies one year on from street attack

Mark Ward required round-the-clock care following the assault.

A Dundee taxi driver has died one year on from a street attack which left him requiring 24-hour care.

Mark Ward was brutally beaten by Steven Greig on Coupar Angus Road in Dundee on April 6 2022.

Police confirmed the victim has now died at the age of 55.

A post mortem is due to take place.

During the attack last year in Lochee, Mr Ward was seriously injured, after refusing to give Greig a cigarette.

Attack left Dundee man Mark Ward with serious injuries

The High Court in Edinburgh heard the taxi driver was pushed on to the road, causing him to fall down a hill and hit his head on concrete.

Greig began kicking him on the head, before fleeing the scene, near the roundabout at South Road.

Mr Ward was to taken Ninewells Hospital after onlookers desperately tried to help him.

Although he was saved by medics, the jury heard during the trial he would require round-the-clock care.

Greig pleaded guilty and was sentenced to five years and four months in January.

Speaking at the time of sentencing Detective Inspector Allan Thomson said the conviction brought a “difficult investigation to conclusion“.

Police Scotland confirmed a report has now been submitted to the procurator fiscal following Mr Ward’s death.

A spokesman said: “We are aware of the death of a 55-year-old man.

A post mortem examination will be carried out in due course and a report has been submitted to the procurator fiscal.”

I'd guess the report to the procurator fiscal is just routine in the case of deaths like this, and nothing more will come of it. The procurator fiscal in Scotland also prosecutes crime, so I'd guess it's kind of like a combined CPS/coroner thing in England.

NHS Scotland wrote:
The Scottish Fatalities Investigation Unit (SFIU) is a specialist unit of Crown Office & Procurator Fiscal Service (COPFS).

SFIU has responsibility for receiving reports of deaths occurring in Scotland which are sudden, suspicious, accidental or unexplained and fall within the under noted categories and deaths which give rise to public anxiety. On a death being brought to his or her attention, it is the duty of the Procurator Fiscal to make an initial enquiry and decide whether, and to what extent, further investigation is required and to instigate that investigation.

I suppose if the death had occurred soon after the incident then the perp might have been charged with culpable homicide (roughly manslaughter) or even murder, but I doubt there's any merit in reopening the criminal case, even assuming it was legally possible, which I don't know :?

I think elsewhere people have been so charged even when death occurred more than a year later so don't know why it would be different in the kingdom of Fife ?

A very sad case

Dundee in the Kingdom of Fife?? :-o

There's probably a better case for saying Brighton is a suburb of London

On the legal note, I'm not sure what the law is regarding this sort of stuff, precisely, but can't think offhand think of any particular case that's comparable. And, if there are, it will no doubt be under English rather than Scottish criminal law :?

I suspect they are now looking at charging the thug for murder or manslaughter.

‘Mark was robbed of his life’: Dundee family’s heartbreak at death of taxi driver a year after attack

Mark Ward was left needing 24-hour care after being brutally beaten by Steven Greig in Lochee in April 2022.

The sisters of a Dundee taxi driver who died a year after he was attacked say their brother was “robbed of his life”.

Mark Ward was left needing 24-hour care after being brutally beaten by Steven Greig on Coupar Angus Road in Lochee in April 2022.

A court heard how the former NCR worker was attacked after refusing to give Greig a cigarette.

Greig pleaded guilty to assault to severe injury, permanent disfigurement, permanent impairment and to the danger of life.

He was sentenced to five years and four months in jail in January.

Earlier this month, news emerged that former St John’s RC High School pupil Mark had died a year on from the incident, at the age of 55 – having spent months in hospital and then a care home.

Now Mark’s family have spoken to The Courier about the months that followed the attack, and his death, for the first time.

Sister Hilary Money, 60, said: “To see what’s happened over the last year to Mark has been heartbreaking.

“Mark was a very intelligent guy. To have such a demise of his life is tragic.

“The last year doesn’t feel like it’s been our life.

‘This robbed Mark of his life’

“Mark was a doting uncle who was incredibly hard-working. He did so much for our parents, Jack and Muriel.

“There is a feeling Mark has been in the wrong place at the wrong time.

“As a family the whole thing has been a massive shock – from getting told in hospital that Mark would require 24/7 care to the significant impact it’s had on our parents.

“This robbed Mark of his life.”

Mark’s other sister, Jacqueline Laing, 57, says the Celtic fan had been planning a trip to Goa in India, using his NCR pension, before he was beaten.

She said: “The day Mark was attacked we got a call from the taxi company to say he’d been assaulted.

“I still remember the call from A&E explaining he was seriously injured and the next 72 hours would be crucial.

“The medical staff throughout all Mark’s care has been fantastic – they said the reason Mark survived was that his heart was strong.

Family’s ‘comfort’ after tragic year

“It feels very surreal knowing that Mark is gone.

“As a family there is some comfort knowing he is at peace now after what’s happened to him over the last year.

“Mark was an independent, fit and healthy guy and worked as a taxi driver throughout the pandemic.

“He was such a caring person and loved doing the school runs with the pupils at Kingspark School.”

Fundraiser by taxi firm

A JustGiving page has been set up in Mark’s memory by City Cabs, which has already raised more than £1,000.

The family say the kind messages and support have also been a comfort .

Hilary added: “Mark had a great and varied group of friends, he was such a popular guy.

“The messages of support have been a real comfort.

“We also can’t thank the police and the medical staff for their support and assistance throughout this.”

Mark is survived by his parents Jack and Muriel.

He also had sisters Hilary and Jacqueline along with brothers-in-law Joe Money and the late Jim Laing.

He is also survived by nieces Jane, Jillian and Clara and great-niece Fenella.

Not much new here, other than what contributors on here were saying further up the thread. And not clear whether this speculation is from legal insiders, or just close family, or whatever.

Didn't think it would be revisited myself, but who knows? And possibly a culpable homicide charge rather than murder. But we'll see :?

LEGAL MOVE Brute jailed for assaulting taxi driver over cigarette could face murder charge

A THUG jailed for more than five years for assaulting a taxi driver could be tried for murder — after his victim later died.

Prosecutors could bring a fresh charge against Steven Greig, 45, for savagely attacking Mark Ward, 55, in a trivial row over a cigarette, sources say.

Mark was left brain-damaged and needing 24-hour care after Greig pushed him to the ground, causing him to hit his skull off concrete, and repeatedly booted him in the head in Dundee in April 2022.

He passed away in January following months in hospital, then a care home.

An insider said: “Mark’s loved ones are just devastated.

“He was a well-known face and everybody is calling for the same thing — for Mark’s attacker to be charged with murder.

"Mark’s life has been cruelly cut short and that should be recognised by law.”

The High Court in Edinburgh heard career criminal Greig, who has 94 previous convictions for 189 offences, snapped after Celtic fan Mark refused to give him a ciggie.

The brute pushed him onto the road, causing him to fall down a hill before kicking him over and over.

Greig, who fled the scene, showed no remorse as he was sentenced to five years, four months in January.

He admitted assault to severe injury, permanent disfigurement, permanent impairment and danger of life.

Mark’s family refused to comment on any possibility of a new trial.

The Crown Office said: “The procurator fiscal is considering a report in connection with the death.”

it would be very hard to convince a court that this was pre meditated murder rather than a violently angry reaction to the situation

I suspect the family has been informed privately by the police.

And the info has leaked out to the press in advance of a police press release.

Well I was wrong about it being revisited, but right about the charge :-|
