The question I would have asked the expert, who said there was nothing the driver could do, is why aren't people being killed on this road every week? :-k

Thousands of cars use this road daily, even if only one drunk lad walks up this road a week at night (and I suspect there are many more) why is this the first fatality that I can remember?

It does read like the kind of case that elsewhere would be a slam dunk against the driver.

Which I often think is a bit unfair on the driver, but on the evidence as presented in the articles it looks like the driver was very lucky to get away with what he was actually convicted of.
