Bogus taxi driver raped vulnerable woman after she begged to be taken home

Mohamad Sabbagh raped the 25-year-old in a secluded spot in Edinburgh whilst operating as an unlicenced taxi driver in an unlicenced taxi.

A predatory bogus taxi driver subjected a vulnerable young woman to a rape attack after she pleaded with him to take her home.

Mohamad Sabbagh drove the 25-year-old to a secluded spot in Edinburgh and demanded sex from her before getting into the rear of his unlicensed taxi and raping her.

The distressed victim later told her mother she begged him to please take her home and told him the address.

Sabbagh, 40, picked up the woman and her friend after they went for a night out drinking and clubbing in the city. He dropped off the friend leaving him alone with his intoxicated victim, who was a stranger to him, before carrying out the sex attack on her.

Sabbagh, of Harewood Crescent, Edinburgh, had denied raping the woman and claimed she consented to sex. He told the High Court in Edinburgh that his passenger asked him for sex and said: “She started seducing me.”

He said through an interpreter: “She was a beautiful lady. She seduced me. I felt weak. She offered and I accepted.”

But the jury at his trial unanimously convicted him of raping the woman on May 1 in 2022 at a car park in the Niddrie area of the city.

The charge set out that he carried out the sex attack while operating as an unlicensed taxi driver in an unlicensed taxi.

Sabbagh claimed that he picked up the woman and her friend after they waved to him to stop his car. He said: “I thought they were in need for help, so I wanted to offer help to them.” He said they were sober.

Advocate depute Ross Price said the Crown’s position was quite clear. He said: “There was no consent to the sex. The complainer was intoxicated and incapable of giving or withholding consent.”

Arabic speaker Sabbagh, from Syria, originally faced a further charge of operating a vehicle as a taxi or private hire car without holding a licence at various locations in Edinburgh, including George Street, Lothian Road and Grassmarket, between October 2022 and October the following year. That charge was withdrawn during the trial.

The victim’s friend told the court that they had gone out together for the evening but decided to head home in the early hours of the morning. She said: “We decided to leave together because we were both feeling drunk.”

They got a cab but she began to feel sick and asked the driver to stop near to the Commonwealth Pool and she vomited outside the vehicle.

She said they both got into a second vehicle and she got dropped off at her street. She said her friend seemed “really tired” and added: “Her head was tilted down like she was getting ready to doze off to sleep.”

She spoke later to her friend in the afternoon and said: “She seemed so beyond upset. I could hear in her voice that she had just been through the most traumatic thing. Her voice was really shakey. She was screaming, crying…She told me what had happened.”

The court heard that after the victim was left alone with Sabbagh she gave him her bank card and PIN to use at a cash machine to get money to take her to her destination, but he failed to get money before raping the woman.

A judge called for a background report to be prepared on the tailor ahead of sentencing next month.

Lady Ross told Sabbagh, who was on bail during his trial, that his status has changed following his conviction and he was remanded in custody. Sabbagh was placed on the sex offenders’ register.

Wonder when we'll read a case of a fake driver attacking a fare who couldn't get a legitimate taxi because they wouldn't accept cards... :?

assuming this was an actual hackney why not ask him to stop for a couple of minutes whilst she got out to throw up then resume the journey ?

Maybe they said they'd just get out rather than signalling that they would get back in.

Or, more probably, maybe the driver didn't want them back in - in fact, kind of surprising he let them in in the first place - both well pi$$ed, obviously on the edge of puking up, so drunk she couldn't use her own cash card, etc, etc.

But often these types don't look too drunk until the trip gets under way...

Of course, that's maybe why there's an opportunity for bogus drivers in the first place... legit drivers fed up with this kind of thing - and the self-evident red flags here - so won't take them.

I've certainly changed my attitude a bit about stuff like this over the years, and try to avoid scenarios where previously I'd have taken the risk.

There comes a point when you think that if people can't help themselves then why should we take the risk in picking up the pieces? And, for example, even after lockdown the likes of Glasgow, Fife and Angus councils extending licensing hours... :roll:

Not as a rule, obviously, but there's no doubt the odd scrote knocking around in a car with a card reader for other purposes who could take advantage if the proper 'taxis' won't take cards...

Not a likely scenario, but maybe just another avenue that fake drivers could use to their advantage...and which just came to mind when the case above mentioned the odd scenario of the victim giving her card and PIN to the perp, presumably because she was too drunk to use it... :?

Indeed it would help in terms of detection, but I was thinking more about enabling the act in the first place...

Of course, the detection element might act as some deterrent, but some of those perps are hardly rational regarding stuff like that...

And the detection thing would assume a payment has been made, presumably upfront.

A fake driver intent on harm could simply pretend to have a card reader to get the victim into the vehicle...

I suspect he was off once they both got out as he clearly didn't fancy a cab full of vomit.

A bogus taxi driver who raped a woman on her way home from a night out has been jailed for seven years.

Mohamad Sabbagh, 40, was branded a "danger to women" for the attack in Edinburgh in May 2022.

A court heard how Sabbagh offered his victim and her friend a lift home following a night out in the Scottish capital.

Believing he was a genuine taxi driver, the women got into the car before one was dropped off at her home address.

The Crown Office and Procurator Fiscal Service (COPFS) said Sabbagh then drove his vulnerable victim to a secluded location and demanded she have sex with him.

He then climbed into the back of the car and raped her while she was intoxicated and incapable of giving or withholding consent.

Detective Inspector Arthur McEwan said: "Sabbagh's behaviour was abhorrent.

"The victim believed he was a taxi driver, and she would be taken to her destination safely but instead she was put through an extremely traumatic ordeal.

"She has shown tremendous strength during this case."

Sabbagh denied any wrongdoing but was earlier this month found guilty of rape following a trial at the High Court in Edinburgh.

Returning for sentencing on Wednesday, Sabbagh was jailed for seven years, added to the sex offenders' register indefinitely, and banned from contacting his victim.

Katrina Parkes, Scotland's procurator fiscal for high court sexual offending, said: "Mohamad Sabbagh is a predatory individual who poses a danger to women.

"The bravery of his victim has resulted in this conviction, and he will now face the consequences of his depraved behaviour."

Its a shame we can't castrate monsters like this. In 4 or 5 years time he'll be free to rape again
