Thanks, YBB - was kind of thinking I'd read that somewhere, but thought I was maybe thinking of some people suggesting that that should be how it works :-o

But if that's the council's rules under the same legislation as 300 other councils, then if examined in court I'd guess it would be deemed unlawful/ultra vires. Either that, or the 300 or so other councils are acting unlawfully.

My money would be on the former, rather than the latter [-(

Clearly requiring a PH vehicle owner to also have an operator's license is outside of the powers of taxi licensing legislation.

But I suspect the council knows that which is why a 5-year PH operator's license for one vehicle is £110, £22 a year.

However, I'm 100% certain that not every vehicle owner lives in the Torbay licensing area, so making them have a PH operator's license is unlawful, in my view, on more than one grounds.
