Ayrshire again :roll:

So basically councillors seem to think someone got off with speeding, and this guy got the six points which should have been given to someone else :?

Connor McColm told councillors that he was sanctioned despite the incident happening outwith his usual shift.

A South Ayrshire taxi driver who was hit with six penalty points said he was charged because his bosses wouldn’t back him up.

Connor McColm, applying for taxi license, told a hearing at South Ayrshire Council’s Regulatory Panel that he had received a fine and six points on his license after a taxi he drove was caught speeding.

Mr McColm said that he did not usually work at the time of the offence, but said the company that he worked for then had failed to provide information about when drivers were working to police.

His application was brought before the panel after a standard DVLA check.

He told councillors that he was working for a different company at the time of the speeding offence.

He said: “Basically, they kept logging me when I worked, what I did, what I earned, they paid out on weekly weigh-ins and weigh-outs.

“So basically a car was caught speeding. They [the taxi firm] wouldn’t then back me up, even though it wasn’t in the time that I usually work.

“I think it was November, December time, and police came out to my house on the March, so it was a good few months after.

“They then asked me if it was me driving, and I was honest with them as I said that ‘honestly, I don’t know’.

“I never speed. So, I’ll, I’ll be honest, I couldn’t tell you.”

He said that the police had not been given any of the work schedule details from the taxi company and had no proof in the form of video images, ‘just the car registration and car’.

He said that, because there was no further information about who was driving at the time and Mr McColm’s admission that he couldn’t be absolutely sure about an incident several months previous, he was given the fine and points.

Councillor Martin Kilbride asked whether the car was registered to him.

Mr McColm responded: “No, the car was registered to them, I drove for them.

Panel chair, councillor Alan Lamont, said that the police would go to the registered keeper at first, and then they would say who was using the vehicle at that time.

He said: “You’ve contested this, and Streamline wouldn’t provide data to back up why they were. Is that the gist of what you were saying?”

Cllr Ian Cavana said: “I’m sorry to say this, but you’ve got six points on your licence.

“I appreciate your statement, very much so. It is unusual. We usually just give a wee slap on the wrist and say be careful, but there are circumstances there."

Cllr Kilbride said: “I propose that we grant the application, because I think there’s an explanation behind it there."

Cllr Lamont replied: “Yeah, I agree. I’d be happy to second that as well.

The panel voted unanimously to approve the application.

I'm not sure I've ever read such an utter load of old bol****s from the driver.

If the cab firm owner doesn't give the details, then he gets the fine. If he gives the details and the driver denies it was him, then a trial happens. If the driver denies receiving any information, then a statutory declaration happens, and the matter reverts back to the beginning.
