We had a driver who was given his licence, in October last year, while the crb was done due to the length of time it can take, then had it suspended due to the none discloser of a spent conviction for drink driving, he took the council to Court this year and won, so no council can hold a spent conviction (7 years I think, Green will correct me), against any person now in Scotland

Hi,
I wrote CRB Checks One. I got my correct one through the other day. I went to the LA the day it came and the licensing lady was off sick! Apparently, no one else in the horribly overstaffed office knew how to process an application! So, still waiting. The woman who dealt with me took my fee and said i might be able to drive as i have a receipt, but i will wait until my photocard comes just to play it safe. The receipt just shows that ive applied, not actually got a licence.
Mine cost £34 and my medical was £70. The licence fee is £16. Im not sure how much my plate is going to cost. My car was a few grand so lets hope the trades there!! :?

Don't know, I've never been convicted of anything, ever. I've been a good boy. :wink:

Scotland may well be different, but down here all convictions are never spent, and councils can take anything into account no matter how long it happened.

Doesn't mean drivers will lose, or wont get a license, but there is no longer any hiding places. :shock:

In the PHM "Round the Councils", Under Swansea, it says that their council there want to go for an ANNUAL, rather than the present three year CRB check. The reason, would appear to be because a taxi driver was convicted of a rape, and got sent down for ten years. (NOT LONG ENOUGH) Unfortunately, this crime would have most likely still have happened, even if there was a WEEKLY CRB check. The CRB can only produce a history on an individual, not a prediction of future criminal activity. The point of the CRB check is to aid Councils in filtering out persons who are not "fit and proper" so that they do not enter the trade in the first place. So, once a CRB check has been carried out, what is the point in repeating them? I was informed last year that a CRB check is only "valid" for one month. If that is the case, why are they not carried out monthly? Do not misunderstand me I am not against CRB checks being carried out. I have survived three now, is there really any need for the fourth, due in July. If I had commited, or was acussed of commiting a serious crime, surely the police would inform the council? Wouldn't they?
