iv,e lost count of the number of times iv,e heard the (its only a taxi some of the time the rest of the time it is a private car) the fact is taxis and ph are licensed cabs all the time as long as you hold that council license, the only time they become private cars is when you hand back the plate

So, being Private Hire when i'm not hired i am in effect not working, in so much as i cant be flagged by a member of the public. Does this mean im then using the "social" side of my insurance and therefore exempt? I have by the way a normal MOT as well so others can drive it who dont have a PH licence.

Once a PH, ALWAYS a PH? "Others" cannot drive it without a PH badge.

Well you cannot do that smiffyz as the cab is used by punters, read what happend to the cabby in Fife at the start of this thread

Thats my point.
My car is only a PH vehicle when i'm working, when not working it's a private car and as such exempt from the smoking ban isnt it?

To stretch it further if i'm not "hired"..........................................

I'm sure you remember the case a few years ago now commonly referred to as " Beavis and Butthead" a taxi is always a taxi if it carries a plate on the back there is no time that it is social and domestic that is enshrined in case history so smoking at any time will be out of the question unless the car is deplated and turned back into a private car

if you are still unsure about wether your cab is a private car when you are not working here is a test you can do, on the day its your private car carry one more passenger than you are licensed to , put some advertising that is not allowed on it (in dundee its sex shops) then drive up to the enforcement officer and explain its your day off ,tell him you will remove the advert when your vehicle returns to a taxi , the no longer a taxi rule probably extends to your badge so feel free to abuse the officer as you feel fit being a private driver he wont be able to do anything :?
