Afraid my mates given up, re his vehicle, the "brief" wanted cash up front, to which I suspected would happen, you ain't paid his bill so you may not pay mine attitude, he resigned himself, rollocks, contacting the finance company to take the vehicle off him, he's paid over half, and do whatever they want to do, the garage bill as well, thats his choice

that might be the best thing in the end.
not a good story though.

Why don't you take the case on anyway, terry, out of the goodness of your heart, to show us all what a diamond geezer you are. I might consider (re) joining.

This is one of the reasons I have gone back to the cheapest car I can get, I drive a 96 omega, when the drivers window got smashed a couple of months ago, I went to the breakers and got one,£40, and fitted it myself. Even if the car is under warranty, they take forever fixing it, which means time of the road.

Grrrrr! I just typed a huge response and it vanished!

Haven't seen any mention of the Supply of Goods and Services Act anywhere on this thread yet! Have a good read of it. Contact your insurers and Finance House ASAP your bound to be paying for Legal Protection somewhere along the lines and use it.

The garage cannot sell the vehicle to recover costs as the finance house legally own the car - goes into the realms of theft if they attempt to!

I've got some personal experience of this kind of situation so drop me a PM and I'll give you more details; but I returned an Octavia 14 months and 120K after purchasing it as it wasn't fit for the purpose for which it was purchased and won!

In my experience the legal assistance offered by unions is not what it is cracked up to be.

If you have a case then No Win No Fee solicitors would be equally competant.

If you don't have a clear cut case then any solicitors will want some kind of retainer ....... whether they are associated with a union or not.

Just taking the basics of this story it seems that receiving a county court summons taken out by the garage owner is beneficial to your freind, when it arrives tell him to fill out the form and fill in the counterclaim for loss of earnings, off the top of my head i would say around £6000 but his accountant would provide the details for that, also get a letter from the main agent/dealer detailing the time the job should take, pay them for their time if you have to, make a reasonable settlement offer, say £1500, the judge will weigh up all the evidence, in my opinion your freind will win and come out of it quids in, if he doesn't win then like has been said before, tenner a week

On Monday at around 13.00 i will pick up a solicitor who will go with me to Bury a talk on behalf of a member for me, not as no win no fee but for free yes free, why well when a driver as a RTA if they want a solicotor we use this one on a no win no fee.

So he will do, not all the time but he will do this short of work for me. so members get best of both worlds.

Beat that GMB.
