So basically because there is no defined 'agent' in any act for hackney carriages, anyone can sort themselves out with a radio system / phone system and take on hackneys. All without the need for any form of license.

Thats excellent, I reckon the firms management, 'Fingers' McGuffy, 'Baby face' Jones and Tony 'The Claw' will see the Hackney Carriage trade in a whole new light.

Aye Sussex....but what if (and this is an extreme example :wink: ) you had a hackney carriage and when you were at work someone phoned your home and your wife accepted a booking for you?

She accepted the booking for a hackney carriage.....not a phv.....so using the same theory....she doesnt need licensed.

Which is pretty much like Gladen, and unless the law is changed so that every HC hiring is recorded it aint going to change.

I tend to think the radio aspect of the law needs sorted....but sorted in such a way to ensure HC's dont have to record street and rank hires.

The cross border H/C issue needs completely sorted...otherwise they'll all be driving around in TX4's :lol:

It seems easier to make it a condition of the PH operators licence that the only vehicles they can take under contract to undertake any bookings recieved by their office must be licensed and driven by people licensed by the same authority that licenses them.

I would suggest that if you asked HC only circuits (of which there are very few compared to PH operations) their opinion would be not to allow HC from outside their area to work on their circuit.

The main supporters of this abuse of the law are PH operators and those operating,I believe, outside of these laws already, just look at recent legal actions.

Maybe its time for official responses from the National Organisations on this issue, because I know that locally for us there is no bigger issue at the moment.

I believe that this activity is illegal, and anyone who is working in Gateshead with a HC from outside Gateshead better make sure that they are fully complying with the law ............ because our LO and enforcement team will be checking.

That condition already exists in the form of statutory private hire legislation. You can't put a condition on a license that would make statutory legislation which is perfectly legal, illegal. You would make a good councillor, they like changing statute law by imposing unlawfull conditions.

I agree with you in all of this.....it simply wasnt the original intention of the law.

But facing facts over here in sheep shearing country we have predominantly HC circuits shoving two fingers up at the LA due to them not having PH operators licenses.

If you look at sction 80 of the 76 act you'll see private hire operator defined....more or less its a person who accepts bookings for private hire cars.....check the same section or the 1847 act for a bit that defines a person accepting a booking for a hackney carriage.

Its going to need a court case or a change / addition to the law I think.

IF that condition already exists JD how are PH operators legally allowing drivers and vehicles licensed in another area to work under contract with them.

If that condition already exists then there is no reason for change ......... more a reason for enforcement.

Ok so if a HC operator starts using HC from another area why not suggest to your local press that the reason they are using these drivers is because the drivers are not suitable to be licensed in your area .............. and then make the most of the fact that all the drivers on your circuit meet the high criteria of your local authority.

I wonder how long it would be before you had HC plated in your area as the only HC working your area.
