Grandad If the owner of the cab dictates when the driver is required to work then he is an employee, if that driver says up yours I'm having a night off what could you do as you say he is self employed.
What happens on a school day when you have contracts to complete and he says I'm off to the pub
So in a nut shell if you decide what hours and when he has to work, he is an employee without question[/quote]

Basic nuts and bolts but this is my understading of it :?

I don't dictate what hours they work. They hire the car from me and pay me the rent and the insurance and they work when they like. If they are doing school contracts and they want to do something else then either my wife or I do the school run or it is subbed to another firm.
Very simple

I hire a cab to another driver. He pays me a set amount every week. I pay all maintenance, insurance, road tax etc. He decides for himself when he works. Does his own tax etc. Worked out well for the last 3 years. Taxman had no problem with arrangement when driver was looked at last year. 8) I don't have any regular contracts (don't like the commitment)
