I gave the paperwork on this to a friend who is licensed hackney in north somerset so she could work as p/h in torquay area. The torquay LA threw it out.

From the other side :wink:

A cab company in Darlington has seen a dramatic reduction in owner drivers and drivers becuase of the way the company is being run by the owner of the operators licence....
She has sought help from abroad in the form of a Polish operater who provides drivers ( TAXIBANK BUSINESS ) throughout the E.U... It doesnt end there though as she is in the process of getting cabs plated in Berwick for them to drive knowing that they will only be able to do Private Hire work and not go wandering off onto the ranks... More or less having a captive fleet of drivers unable to work elsewhere other than in Berwick.. What she is doing is ignoring the LAs advice that anyone useing an out of area cab to do Private Hire work in Darlington will not have their Operators Licence renewed when it is due for renewal...


We shall just have to wait and see what the LA are going to do about it..

She has recently had a visit from the LA asking how a company can run with only 2 Darlington Licenced Private Hire cars????
Maybe the few Berwick cabs are helping her out!!!!!

Well blow me down with a feather.. Her Operators Licence is about to be reviewed at the next Licence Committee meeting to be held on the 29 August 2007...
She has stated that the Berwick cabbies are only working in Darlington to learn the job making it easier for them to pass the relevant critearia that Darlington has adopted as policy for cabbbies...
Wonder whats going to happen then????

Not a lot I would think as they are plated hackney, and are free to work as PH in any area

Would it be reasonable for the LA to impose a condition that only locally licenced cars are used?

Although I believe that Newcastle might be in the process of a Judical Review over the Berwick issue.

Do you mean Newcastle have given up their chest beating and have taken TDO's advice in respect of one of the solutions we put to them all those many months ago?

Wonders will never cease.

My money is on them doing absolutely nothing and if they do then they are doomed to failure.

The point being who can recommend a course of action for her?
Cleary she can work from a p/h firm down there using her hack licenced in n/somerset.
Anyone give me the info to give to her to slam on the desk of the LA that will force them to get there solicitors to be involved and look at the case (case meaning she has a copy of the Brentwood vs Gladen. This is what the LA said was rubbish and did not apply to them)

Firstly there is nothing the LO can do to stop your mate working where she wants. Just do it.

I would send a 'freedom of information' request to the council asking them for the reasons the Gladen judgement doesn't apply.

If she licenses her vehicle somewhere else she does not come under the present licensing regime. Therefore the LO or LA have no power over her whatsoever.

If a local Radio firm won't take her on then she can operate from home.
