The council could have another option open to them and that is recall all plates and re- issue them only to operators that drive
I don't think they can legally do that.

I think they can as they own the plates not the Barron's.

I think most of the folks on here know they can't do that. [-(

Maybe JD should send them a copy of the Wirral-v-Royden judgement.

That's true, however they can't just take a plate without good reason.

Under normal circumstances a license can only be revoked if the person is "not fit and proper". The courts have deemed that a renewal is just an extension of the license and therefore it must be renewed if all the criteria for renewal is met. So basically if you are issued a license then its yours for life.

However to aid Skippys position there was a case in Yorkshire perhaps York itself where a dying elderly lady transfered her vehicle to the gentleman who drove it but when renewal time came around the council refused to renew the license. The case went to court and the council decision was upheld, which I must admit surprised me.

Naturally those cases are on TDO as per usual.

Regards

JD

Yes, I deleted it.

It was just to mention that the Weymouth reference was incorrect because that refers to plate transfers but I just deleted the reference from the other post.

Here is the York Case from 1990. Perhaps someone from York remembers?
