Good news, it's about time a decent and correct decision came from the courts.

There must be nothing worse than sitting as the defendant knowing you're not guilty on a manslaughter or murder charge.

I think the person at the CPS who decided there was a case against the driver should themselves be up in court on charges of wasting tax payers money and for being a fúckwit.

Could he claim compensation, I think wrongful arest wrongfully charged, pain and suffering, if this happened in the USA the compo would be in the millions

A sensible decision. Shame he had to endure a few months of worry though.

Still that's the legal system we have, and the outcome is, as it should be, justice for the accused.

Fatal fight over a sausage was such a tragedy

A TAXI driver cleared of killing a man over a chip shop sausage today said he never lost faith he would be freed.

Luke McCormick, 53, walked free from Liverpool crown court having been cleared of the manslaughter of Gary Jenner.

A judge ruled that Mr McCormick had no case to answer four days into a trial into the death of Mr Jenner, 28, outside Tsang’s takeaway in Stanley Road, Bootle, on January 14.

The prosecution had alleged that the defendant had used “excessive, unnecessary and unreasonable force” to restrain Mr Jenner.

Mr Jenner, who was three times over the legal drink drive limit, had asked strangers in the chip shop to buy him some food.

He had swung a punch at Mr McCormick’s partner, which missed.

Mr McCormick then had to restrain Mr Jenner after he was punched. He held him until police arrived, but he later died.

Today, Mr McCormick told the ECHO he had placed his trust in the legal system.

He said: “I will not forget the incident and am truly sorry that the gentleman died. I have no doubt that his family and friends are and always will be grieving.

“They deserve answers, but my case was not the answer they were looking for and I am truly sorry for their loss.

“What happened that evening has affected many people and the events will always be with me, but I have always been mindful that my actions were reasonable and all I did was restrain a man. I never lost faith in our legal system.”

Mr McCormick, of Pennington Avenue, Bootle, had offered to pay for some food for Jenner in the takeaway.

But the pair ended up rowing over a sausage and a fight ensued.

A taxi driver radioed others for help and Mr Jenner was held to the ground, with Mr McCormick restraining him in a head lock. Mr Jenner, from Litherland, lost consciousness and was taken to hospital where he died.

The court heard the cause of his death was suffocation and neck injuries.

My horror at death in fight over a sausage

A MAN would “rather have taken a hiding” than see a man he was arguing with over a chip shop sausage killed, a court was told.

Taxi driver Luke McCormick, 53, said he only tried to restrain Gary Jenner after the pair rowed outside a Bootle takeaway, but would have stepped away had he thought he was doing him any harm.

Mr Jenner, 28, from Litherland, died from suffocation and neck injuries after an incident in Tsang’s, in Stanley Road, on January 14.

McCormick, of Pennington Avenue, Bootle, denies his manslaughter.

During the trial, Liverpool crown court has already heard how Mr Jenner stumbled into the takeaway drunk with only 7p in his pocket and asked strangers to buy him some food.

The court heard McCormick offered to help, but the pair got into an argument over a sausage and the victim punched McCormick’s partner, Peggy, before striking the defendant.

There was a scuffle, during which McCormick grabbed Mr Jenner in a headlock and led him outside, away from the shocked takeaway queue, jurors were told.

Eventually four people were needed to subdue Mr Jenner, who was three times over the drink-drive limit, with McCormick on his back. The court yesterday heard the defendant’s police interview, during which he said he never meant to hurt anyone.

In his questioning with detectives, McCormick said: “My intention was never to cause any harm to anyone. I would have stood up and walked away if I though I was hurting him.

“My thought was to hold him until the police arrived so he didn’t have the chance to hit me or Peggy again.

“But I would have stood up and rather have taken a hiding than have things end up like this.

“I only used reasonable force. I’m not a violent man. I never get in fights because I don’t like getting punched.

“I felt him resisting all the time I was on top of him.”

Peter Davies, prosecuting, claims McCormick used “excessive, unnecessary and unreasonable force.”

He was due to give his version of events to the jury today.

I've been reading all of the comments posted on the site but thought that would be inappropriate for me to make any comments until after the trial. Now the trial is over and the correct verdict has been reached may I thank all of you you gave me support through what was a horrendous time for me and my partner Peggy. The support I have had from ALL of the trade has been fantastic. This support includes drivers,owners council officers (at all levels) and councillors. I was happy to appear in front of the councillors before my trial as I have always been an advocate of ensuring the highest safety standards for the travelling public. Maybe some of you have a point that it should be decided by the courts alone.....who knows, that idea may appear at a future trade meeting. Being a trade rep doesn't always endear you to many people. There are always people who are never satisfied with whatever the majority decide and over the years I have had a few spats with people that have got rather heated(actually most of them with Mr T), but the reaction to my circumstances has been overwhelming and I have been genuinely touched. People I have not spoken to in years have offered me support and it has made me feel more proud of the trade than I have done in years. It has also changed my perspective on a lot of things. Things that we do every day are important...but the most important thing we have it life, whatever the quality and the condition with which we live it.
