Can someone remind me exactly what Berwick are meant to do if a 'fit and proper' person presents a 'fit and proper' vehicle to be licensed? :?

On what grounds can they refuse? :?

They can't refuse. lol But we all know that and I expect so will the Judge.

Regards

JD

I dont think they'd have been given leave to seek Judicial Review if it was quite so simple as that old chap.

I suppose it'll all sort itself out, but I think Berwick Council are asking for trouble, especially from April when the Corporate Manslaughter Act becomes statute...

How can they control vehicles from 60 odd miles away? and what happens if they license a person who has been refused by other councils and he kills or maims someone?

How anyone can defend Berwick is beyond me especially when they use standards as their major argument.... at any time..

So what exactly is the Berwick LO to do?

Does he think up new by-laws conditions prohibiting drivers from working outside of his area? :?

And maybe if Newcastle spent a fraction of what this will cost on proper enforcement of illegal plying, then one has to wonder if the problem will remain.

I suppose if he licenses on new issue only WAV's that would kind of sort part of the problem.

A knowledge test would sort another bit.

Hows about revoking licenses that arent used in the district?

I suppose if he makes the vehicles take tests within Berwick district that would sort another few drivers out.

I suppose if Berwick council sack him that would resolve it completely

You always confuse.... they.... with he...... he advises them, and that is what he is paid to do, and it looks like he is making sure that his advice is what is best for him.... more responsibility,,, more red tape,,,, bigger salary.

That they are granted to serve the prescribed distance and not Newcastle's?

That they aint being used?

Sod it lets get rid of section 16 and give the power back to the local authorities to restrict licenses for no other reason than they dont like issuing them

Ok lets say that Newcastle win the case, which I personally can't see happening.

Then all those drivers licensed by Berwick could just go and find another council in another country.

Remember the 1976 Act doesn't apply to vehicles licensed by the 1982 Act. :-$

They are allowed to serve the local community, not required to.
