If I am short sighted then I have been that way for some considerable time because I've consistently been in favour of a new act.

Even allowing for your popularity I doubt many would agree with your visionary statement that "anybody in any member state as long as they are licensed in their member-state can work in England. licensing of cars and drivers in Poland and company in Poland and work Brighton".

The delivery is a little garbled but I think we get the flavour of your comments. I would like to ask you one question but I doubt I will get a straight answer and that is, "would you like a new act or do you prefer to keep what we have"?

I suppose it is more about trust, do I trust the people in power to get it right, and supposing a new act was presented to the department of Transport would I trust them not to sell it short, and eventually when the minister gets his name behind it and start altering it to suit our friendly EU neighbours in Return for what.. Blur becoming the next President..... let's face it, the laws they have changed now have really put us in good stead, protect your home and end up in jail paying compensation to the poor little mites that didn't know any better....ps, remember the CRB checks only apply in Full if you are British. :cry:

The question deserved a simple "yes" or "no" answer. I take it from that response your answer is NO.

A simple question for anyone who can answer, if we had a new Taxi Act.. would all the existing case law become obsolete ..

Only those that are repealed by the new act.

Laws still apply from the 1847 act even though we have had the 1976 and 1985 acts. :?

Well JD...your missing the whole point..I dont want a Vehicle with TAXI on the top in nice Bright lights and the Restrictions in charging it brings, Nor do I want to Have the Ability to Hack as My area doesnt suit Hacking, Nor do I want A great big Ugly Meter Sitting on my Dashboard Gathering Dust. Im quite happy with the Flexiblity that PH Permits..I Dont Tread on Taxi drivers Toes and nor have I ever Phlimped or whatever you call It....if it works why should I fix it. Your Nitpicking makes me think you may have Wrote the Blessed Questionaire personally.....Long Live PH!!! and Taxiing!!!, each to their own.

I can understand that but once again that is the minority view of most private hire drivers as can be seen by the legal cases brought against those councils who have tried to remove illuminated signs. I think all hackney carriage drivers wished all private hire drivers were like you.

No one knows what type of charging regime will be in place under a new act and besides private hire drivers cannot set their own fares so the charging of fares is not your problem unless you also happen to be an operator. Is it a case that you would wish to charge more than the meter fare because there is no restriction on you charging less.

So you don't get any flaggers in your area and you have no cab ranks? Has it never occurred to you that there is no difference in the operation of private hire whether it be by hackney carriage drivers or private hire drivers. If you don't want to pick up off the street then that's your choice, no forces you to do that but everyone on here to a man will find it a little strange that you prefer to drive past flaggers.

These days meters aren't that ugly but it may be that under a new act regardless of whether you are hackney or private hire that there is every possibility that meters might be made mandatory.

Nit picking at what? Your original post said the questions were loaded and biased and the questionnaire smacked of more needless regulation. I merely asked you "to which questions were you referring"? You haven't given us any indication as to what those questions are.

I'm sure there are many private hire drivers who would welcome new legislation and I would stick my neck out and say they outnumber those that don't.

I notice you are in the Dumfries area.
Any changes to hack/ PH legislation in England and Wales should not affect you, unless you work there. :?
Scotland is covered by the 1982 Act.

The way I see it is that drivers should be able to choose, and if they choose not to, then great. :wink:

The Flexibility is Obvious...your in some strange state of denial , Ive no wish to Pick a fight but it does seem to me that unless its to your way of thinking its automatically wrong..its your way or no way! JD...

(1)I can Set my own Fares.
(2) Those Fares for the most part would be less than the areas Hackneyed fares If there were Any).
(3) I dont have to Purchase a meter.
(4) I dont have to Purchase the Taxi drivers Licence/Badge on top of the PH licence/Badge ive already Paid for.
(5) Why pay for the right to hack when ive no where to hack from.
(6) I still dont want a Big wind Jammer of a taxi Sign on top of my Vehicles (Fuels Dear Enuff).
(7) People use me Knowing the Fare price in advance of the Booking.
(8 ) My Insurance is Possibly Cheaper.
(9) Im a Country PH passing through back lanes and Country Dells...who the hells going to flag me down there....
(10) I Like PH..so why the hell should I change.


Now!..that might seem an incredible list of alien concepts to some, but to Hill Billy Boggins here it makes a whole load of sense just in the same way I wouldnt Buy walking boots if i didnt have legs I'l not Buy the Taxi Idea if ive no where to Hack..

Its been said you operate in Scotland if that is the case then the questionnaire doesn't apply to you so your initial comment is most curious.

In England and Wales only a private hire a operator can set fares, if a private hire driver sets his own fares then they are breaking the law. I assume you don't operate in England or Wales.

In England and Wales, hackney drivers can charge what they like below the metered fare, therefore there is no difference between hack and private hire in that respect. Under a new act and under a similar system as is applied today in England and Wales you would also be able to charge what you like as long as it wasn't more than the prescribed fare. There is every possibility that in a new act fares might not be regulated by the commissioner in which case that would mean you set your own tariff.

Many areas in England and Wales have dual licensing and under a one tier system you would only need to purchase one license.

As I said, many authorities in England and Wales have dual licenses therefore the price is the same. On the other hand some don't.

That's fine, people using a hackney cab are aware that what they pay is displayed on the meter and further more the driver gets what they are entitled for the distance covered.

It would seem you are happy driving private hire in Scotland and no one is proposing changes to Scotland so you wont have to change but it makes me wonder why you made the pretence by your opening statement which alluded to you being affected by the questionnaire when in fact it doesn't apply to you. Most points on your list are inconsequential because they do not apply even under current legislation in England and Wales.

The questionnaire is designed for a new taxi act in England and Wales, if you are not in either of these two countries then just say so and we can

But the new act is for England and Wales so how would it hasten the demise of a private hire driver working in Dumfries?
