I was hoping to use this case to show inconsistancy. There was also a case where 2 drivers were having their badges revoked after a racism hearing. They were appealing to the magistrates court and on the morning of the hearing an agreement was made between the drivers and the council which stopped the case. Again I can't get any information regarding their "punishment" from the council due to confidentiality.
Send in an official FoI request, asking, generally, for the info you require.
Along the lines of how many drivers have been investigated for over-loading in the last X years.
What was the outcome of those investigations?
You could actually widen the requests asking how many complaints the council have had about drivers and vehicles, and again the outcomes.
If they have had dozens and you fella is the only one losing his license then that will help.
And of course if they refuse to answer you can appeal to the Information Commissioner.
