oh, so its the whole PH trade you cant compete with, not just the re-plated E7?

From what I have read the decision is basically down to your local authority, they can agree with your point that the vehicle resembles a hackney carriage so they will not license it as a PHV - or they can disagree and license it.

Your legal options are set out in point 7 of the section of the act I quoted;

Any person aggrieved by the refusal of a district council to grant a vehicle licence under this section, or by any conditions specified in such a licence, may appeal to a magistrates’ court.

You could win in magistrates but it would be at your own cost and your council may appeal to a higher court.

Of course, allowing ex licensed taxis to operate as private hire - complete with taxi signs - obviously undermines your councils own policy - which is presumably licensing WAV's as taxis to ensure there is a difference in appearance between taxis and phv's.......to this end perhaps you should find your councils original proposals regarding licensing purpose built vehicles as taxis - if they were like ours (back in 1982) ours basically gave that exact reason.

Thanks captain, la are looking into this for us with the legal, as when the other one that was allowed, was a different head of licensing.

The licensing function is there to enforce the policy of the council - not enforce the policy of your licensing department - you have the tail wagging the dog.

what about without them?

an E7 isnt built as a taxi is it, its converted from a plain stock factory built van/mpv

and with taxi signs on its a taxi - so the council simply disallows the taxi signs - thus allowing it to be PH

what about without them?

an E7 isnt built as a taxi is it, its converted from a plain stock factory built van/mpv


Maybe that's the difference...Citroen Dispatches and Peugeot Tepees were designed before the Van versions, that was so as they could be classed as cars and not as Van Derived Cars, so I guess a Conversion from a Van would actually be Car Derived Van with windows in and not technically a car. :?:

not important

our complainant's problem is that an E7 shouldnt be a PH....if its OK for H&R then yes it should be provided it is compliant with PH regs

if his LA decided all HC should be white and all HC shouldnt be white then a red Scudo 8 seater would be fine

do the public care?....no

All I'm saying is that in this town e7 are recognised as hackneys, and to have e7 as private which would look like a hackney without the peak, could make it difficult for the public to know the difference.
