From what I have read the decision is basically down to your local authority, they can agree with your point that the vehicle resembles a hackney carriage so they will not license it as a PHV - or they can disagree and license it.
Your legal options are set out in point 7 of the section of the act I quoted;
Any person aggrieved by the refusal of a district council to grant a vehicle licence under this section, or by any conditions specified in such a licence, may appeal to a magistrates’ court.You could win in magistrates but it would be at your own cost and your council may appeal to a higher court.
Of course, allowing ex licensed taxis to operate as private hire - complete with taxi signs - obviously undermines your councils own policy - which is presumably licensing WAV's as taxis to ensure there is a difference in appearance between taxis and phv's.......to this end perhaps you should find your councils original proposals regarding licensing purpose built vehicles as taxis - if they were like ours (back in 1982) ours basically gave that exact reason.
