Am I reading this right, you have a school run that takes x length of time to do but you pay a driver y time to do it? Did you not check how long it would take to do it before you gave him the job or for that matter before you tendered for the contract? Just tell him it takes x time to do it and pay him accordingly.

Yes we did check how long the job would take on the computer
and by actually driving the job. The problem with just telling him that the job should take X time and that is what we will pay for is the fact that he is an employee. How would I stand legally if I told him that for instance, 3 members of staff have all driven the job and it took all of them the same time within 5 minutes, so regardless of the time it actually takes him, that is all we will pay him. For instance what if there is a traffic hold up or one of the students is late out of the house?

Without knowing how many hours you actually pay him and many hours it actually takes to do the job it's difficult to answer, but, surely some days it won't take as long and other days you may get a small delay. Obviously big long delays are not a regular occurrence and can be dealt with ad hoc. You could simply give him 2 weeks notice and then find somebody else, unless you've signed a contract stating otherwise.

Our contract with the drivers is 4 weeks notice by us. But you have to have a legal reason for terminating someones employment. You can't just sack someone. He has been employed by us for 6 1/2 years and has rights. We also can't make him redundant because it has to be the job that has ended before you can do that.

Redundancy doesn't count for the over 65's. Anyway, you couldn't make him redundant if he was under 65 a the job is continuing.

There should be no problem saying the job takes x time and that is what you will pay. If there's lengthy delays then pay additional amount accordingly. But what you are doing at the moment makes no sense. The man seems to be taking the P155.

After all, if it was a registered bus route he was driving, he would be expected to be able to drive to keep within the parameters of the registered timetable and get paid accordingly, not take 20 minutes more just because he felt like it.
