Update: As of Friday 29 May 2015 the police have released his car at a charge to him of £250, his windscreen cannot be completed by the insurers preferred installer until 16 June, so he is paying a local firm £200 to fit it on Monday 1 June. Plus a loss of approx. £1000 in loss income over last weekend and Bank Holiday. Police have just confirmed that they are treating the matter as ''pedestrian error'' so don't know where we go with this now. I understand that the pedestrian has been at home for several days and is nursing a sore head. Perhaps he is now considering a civil case !

remind your mate that depending on his local council, he will have to declare the incident and have the vehicle inspected before returning it to the road for work.


lots of guys don't but not worth taking the risk of having a badge/plate revoked at a later date

Many thanks for that.

Council have been informed, only a confirmation email from them. Only damage to the car is a cracked windscreen.

Your mate should be considering a civil case. If the police are saying it was pedestrian error then he should certainly be looking into it. where there is blame there is a claim works either way.

Any update/action from your mates Insurance company.

I was completely exonerated by the police in my situation of any wrongdoing - unfortunately the Ins company still tried it on.

No doubt there's a similar expression in English legal circles :lol:

As mentioned in an earlier post; the Ins company request that an ins investigator is allowed to come to your house just to take a statement and to get your side of the story. The approach is on the lines of " You/I have nothing to worry about as this happens all of the time" all we are doing is collating enough evidence to stop/defend against the other party making a claim some years down the line. Yes they are doing that! unfortunately they are also as mentioned ( not that you realise it at the time) trying to apportion just a teeny weeny bit of blame to your mate by seemingly innocent questions. If he does not know the answer/s to a given question do not be lulled into giving estimates e.g I was as witnessed travelling less than 30 mph in a 30 mph area! I was asked by the investigator what was my actual speed? I said I did not know as I was watching the road, but I did know I was under the limit. He then says, look this is only to fill the gaps in was it 20 to 25 mph or was it 15 to 20 mph? I said I do not know...oh just give us a figure he said. Okay I said, put down 15 to 20 mph if it was that at all.

They then used that figure of speed against me by saying that I was (in their opinion) 10% to blame, as it laid open a "Potential" claim against the company, as I should have seen/anticipated the ped action, and I should have been within a speed that I could stop. All complete b*ll*cks, designed to knock nearly 3 years of my no claims bonus. It would have cost me somewhere in the region of £3/3,500 in increased premiums over the coming years, to get back to where I was.

It took me 15 months of fighting them and the Ombudsman, who is a total waste of time. In the end it was a simple £25 cost and I am taking you to a small claims court......they then put their Sol in touch as they are going to fight the case......who then gives in as it gets closer, as they realise you/I are not going to buckle/give in - complete ar$eh*les.

As a 'bystander' I am infuriated by all the unfairness of this and those scenario's in this thread, so goodness only knows how those directly involved must feel.

I had my NCB suspended after truck hit ME, i reported it all, when it became obvious the driver/firm were not accepting liability I paid for a cash repair, then the driver/firm tried to sue ME, it was then I had to counterclaim, after 5 months they backed down, after another 2 months I got my £750 back from my insurers

If the police are blaming the pedestrian, then a civil judge will not go against that.

In respect of the windscreen, all the national windscreen firms will do the work, and insurance companies will pay them out. All you mate needs to do is pay the excess.

Go online and you will also see loads of examples of people involved in non fault accidents, who have been penalised by Insurance companies, who are no more than legal crooks.

He just had a telephone call from insurance company , he is to expect a visit from a company called Paynes, loss adjusters; a quick search suggests that they might be based in Worthing. So the post from Cabby John 1 seems more pertinent now. So expecting an inquisition now.

You he should have had Union membership they would have dealt with this as part of your membership :D

Insurance companies have one philosophy NEVER GIVE A MUG AN EVEN BREAK !
