As mentioned in an earlier post; the Ins company request that an ins investigator is allowed to come to your house just to take a statement and to get your side of the story. The approach is on the lines of " You/I have nothing to worry about as this happens all of the time" all we are doing is collating enough evidence to stop/defend against the other party making a claim some years down the line. Yes they are doing that! unfortunately they are also as mentioned ( not that you realise it at the time) trying to apportion just a teeny weeny bit of blame to your mate by seemingly innocent questions. If he does not know the answer/s to a given question do not be lulled into giving estimates e.g I was as witnessed travelling less than 30 mph in a 30 mph area! I was asked by the investigator what was my actual speed? I said I did not know as I was watching the road, but I did know I was under the limit. He then says, look this is only to fill the gaps in was it 20 to 25 mph or was it 15 to 20 mph? I said I do not know...oh just give us a figure he said. Okay I said, put down 15 to 20 mph if it was that at all.
They then used that figure of speed against me by saying that I was (in their opinion) 10% to blame, as it laid open a "Potential" claim against the company, as I should have seen/anticipated the ped action, and I should have been within a speed that I could stop. All complete b*ll*cks, designed to knock nearly 3 years of my no claims bonus. It would have cost me somewhere in the region of £3/3,500 in increased premiums over the coming years, to get back to where I was.
It took me 15 months of fighting them and the Ombudsman, who is a total waste of time. In the end it was a simple £25 cost and I am taking you to a small claims court......they then put their Sol in touch as they are going to fight the case......who then gives in as it gets closer, as they realise you/I are not going to buckle/give in - complete ar$eh*les.
